2. This permitted temporary conditional use shall be for a period of two (2) years beginning on March 15, 2022, but may be sooner terminated if Applicant fails to comply with any of the conditions, restrictions and obligations set forth herein. In the event of noncompliance, the Hall County Board of Commissioners or the entity having jurisdiction, shall notify Applicant in writing of such noncompliance within 30 days of receiving notice, said permit may be revoked or terminated upon notice to Applicant and hearing before the Hall County Board of Commissioners or the entity having jurisdiction. 3. The premises shall be maintained in a clean, neat, and orderly condition. 4. Applicant's haul road route shall be Road 70 north from plant site to Airport Road, then west to Road 80 or east to Road 60, and then to Hwy 2. Due to bridge structure issues, Applicant is prohibited from hauling on Road 70 between Airport Road and Hwy 2. 5. This permit may be terminated by the County Board of Commissioners for any act or acts of noncompliance with the terms and conditions of this resolution. Prior to any such termination, the Hall County Board of Commissioners shall provide written notice to the Applicant of any act or acts constituting noncompliance. Applicant shall have fourteen (14) days to cure such noncompliance. In the event Applicant fails to cure such noncompliance, the Hall County Board of Commissioners may terminate, revoke, or suspend the rights and privileges authorized by this resolution. 6. Nothing in this grant of conditional use shall be construed as a grant of right, authority or privilege permit to allow any use of land, equipment, materials, or methods which violate any State or Federal Law or Rule or Regulation of a Federal, State or Local Agency other than as specifically set forth herein. Applicant shall comply with all applicable State and Federal Laws and Regulations. 7. The acceptance by Applicant of any benefits or rights pursuant to this resolution shall constitute Applicant's agreement to be bound by the terms, conditions, and restrictions of this resolution. 8. The Applicant shall notify the Hall County Board of Commissioners in writing prior to any assignment or transference of the rights, privileges, and obligations granted by this resolution. This Temporary Conditional Use Permit is hereby granted this 15th day of March, 2022, subject to the terms, conditions and restrictions above set forth.
