RESOLUTION #22-013 <br /> A RESOLUTION FOR THE TEMPORARY CONDITIONAL USE OF A PART OF THE <br /> SOUTHWEST QUARTER (SW1/4) OF SECTION EIGHT(8)TOWNSHIP ELEVEN (11) <br /> RANGE TEN (10) WEST, OF THE 6TH P.M., HALL COUNTY, NEBRASKA FOR AN <br /> ASPHALT AND/OR CONCRETE BATCH PLANT TO BE LOCATED AT 1505 70TH ROAD <br /> WHEREAS, Werner Construction Inc., as the tenant and/or licensee, hereinafter referred to as <br /> "Applicant," has made application for a conditional use permit for the conditional use of the <br /> following-described real estate, to wit: <br /> CENTER TWP PT W 1/2 SW 1/4 SECTION EIGHT (8) TOWNSHIP ELEVEN (11) RANGE TEN <br /> (10) WEST, OF THE 6TH P.M., HALL COUNTY, NEBRASKA; and <br /> WHEREAS, Werner Construction Inc. is the Lessee of this land through a Commercial Lease <br /> Agreement with Southern Public Power District, "Owner"; and <br /> WHEREAS, the above described real estate is located within the AGR-1 Zoning District; and <br /> WHEREAS, Applicant has presented an application for a Conditional Use Permit to the Hall <br /> County Board of Commissioners requesting a Conditional Use Permit for a temporary asphalt <br /> and/or concrete batching plant; and <br /> WHEREAS, on March 1, 2022, a Public Hearing on said application was held at the regular <br /> meeting of the Hall County Board of Commissioners following notice of the same as provided by <br /> statute; and <br /> WHEREAS, The Hall County Board of Commissioners finds that such use is authorized under the <br /> Conditional Uses within the AG-R District that such use, as limited herein, will not adversely <br /> affect the public interest and that said Board is empowered under the Zoning Resolution to <br /> permit such conditional use. <br /> NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the evidence presented and the <br /> factors to be considered pursuant to the zoning regulations, the Hall County Board of <br /> Commissioners grants to Applicant a Temporary Conditional Use Permit to use the above <br /> described real estate for a Temporary Asphalt and/or Concrete Batching Plant Subject to the <br /> following conditions, restrictions, and limitations upon the use of the aforesaid property by <br /> Applicant and Owner, and their permittees, licensees, tenants, and contractors: <br /> 1. The Applicant may erect and operate an asphalt and/or concrete batch mixing plant <br /> upon the property listed above for the manufacturing of road paving material. <br />
