WHEREAS, the above-described property is located in a district presently zoned for AG-SI use; <br /> and <br /> WHEREAS,the proposed conditional use in a district zoned AG-SI is a permitted conditional use <br /> pursuant to the zoning regulations of Hall County,Nebraska, as amended; and <br /> WHEREAS, the proposed conditional use is consistent with the Cornhusker Army Ammunition <br /> Reuse Plan; and. <br /> WHEREAS, on August 18, 2020, a public hearing on said renewal application was held by the <br /> Hall County Board of Commissioners upon due and proper notice of said hearing; and <br /> WHEREAS, at said public hearing the public was given the opportunity to speak in favor of and <br /> in opposition to the application for conditional use; and <br /> WHEREAS,the Hall County Board of Commissioners finds that such use is authorized under the <br /> conditional uses within the AG-SI Zoning District; that such use, as limited herein, will not <br /> adversely affect the public interest;and that said Board is empowered under the Zoning Resolution <br /> to permit such conditional use. <br /> NOW,THEREFORE,BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County, <br /> Nebraska,the Hall County Board of Commissioners hereby grants to Mid-Nebraska Disposal,Inc. <br /> a Conditional Use Permit to use the above-described real estate for the purpose of operating a yard <br /> waste composting site,subject to the following conditions and restrictions: <br /> 1. The above-described real estate must, at all times, be kept in a clean, neat and orderly <br /> condition. <br /> 2. No waste other than yard waste shall be placed or stored upon the real estate. Permittee shall <br /> take reasonable measures to prevent third parties from dumping any other waste on the property. <br /> 3. No uses under this Conditional Use Permit shall result in air, water or groundwater pollution <br /> which creates an unreasonable hazard or nuisance to the adjacent land owners or to the general <br /> public. <br /> 4. Nothing in this grant of a Conditional Use Permit shall be construed as a grant of right or <br /> authority to allow any use of land, materials or methods which violate any state or federal law or <br /> rule or regulation of federal, state or local agency other than as specifically set forth herein. The <br /> permittee shall comply with all applicable local, state and federal laws and regulations including, <br /> but not limited to,those pertaining to water quality,flood control and protection and environmental <br /> quality and protection. <br /> 5. The rights granted by this permit of conditional use shall not be assignable or transferable,and <br /> shall not run with the land. <br /> 6, The acceptance by permittee of any benefit or right pursuant to this resolution shall constitute <br /> permittees agreement to be bound by the terms, conditions and restrictions of this resolution. <br />
