6. UPDATE ON AMICK ACRES - Mr. Riehle stated that they continue to work on the <br /> diversion project. They have seeded the slopes of the ditches and are considering <br /> placing clay on the bottom of the ditches. They met with the property owns regarding <br /> the berms on the south side of Leisure Lake and he noted the area on the map. The <br /> HOA for Amick Acres East built the east west berm but ran out of dirt and this is a <br /> private lake. The county built the last part of the berm there is a gentle slope and it <br /> stops the water from the field. When you live along a lake it is ground water and it can <br /> come up at any tie. There is no outlet on the lake. The west ditch is almost completed <br /> and they have culvert pipe ordered but are waiting on the utility updates and information <br /> on the phone lines so they are waiting and do not want to cut them. They moved to <br /> work on a different pipe on Binfield Road. They put in a 42 inch pipe on Benfield Road <br /> and he noted that the gas lines had to be lowered and they put in some crushed <br /> concrete so the lines will not wash out. <br /> Looked at the job costs and the HOA has spent $45,000 on their ditch projects and the <br /> berms and to date the county has spent $68,000 for labor and equipment. The county <br /> has spent $30,000 on culverts, $10,000 on piling $3,000 on crushed concrete but they <br /> will be able to pick up some of the concrete so it will be about $2,000 and they spent <br /> $1,000 on sand. He estimates that to finish the project it will be close to $150,000 for <br /> the in-kind services and actual purchases. The board will need to make a decision on <br /> the extra dirt. <br /> Mr. Riehle stated to finish the project they have some seeding and work on the berms. <br /> He ask what the board wants to do with the extra dirt. Steve stated he talked to Sarah <br /> Carstensen about building the berms and if he could make the dirt available to the HOA <br /> to build the berms. He showed the location of the berms and they would prevent <br /> additional water going into the lakes. <br /> Hartman ask if the county should haul the dirt or give the dirt to Amick Acres it could be <br /> $25,000 to $30,000 to haul the dirt out but they need to decide soon because it will be <br /> completed soon. They can give the dirt to HOA or haul the dirt to Alda. <br /> Lancaster ask Deputy County Attorney Sarah Carstensen if there were any legal <br /> concerns. She stated that the dirt does have value but it would take man hours to <br /> remove it so it may be better to give the dirt to the HOA. She also stated that building a <br /> berm on private property and issues with water right and Ag land cases do go to court <br /> frequently. They do not want to volunteer services and they must make it clear and <br /> then decide how to proceed. <br /> Hartman noted that it would cost too move the dirt. Steve stated that that this is a <br /> bigger scale and a larger amount of dirt. The HOA had to pay for dirt that was brought <br /> in. <br /> John Amick, 410 Amick Avenue, Doniphan stated they have a family foundation and <br /> donated $20,000 to the Doniphan Community Association to offset the pumping costs. <br /> 3 <br />
