6(b) APPROVE CONDITIONAL USE FOR WERNER CONSTRUCTION COMPANY <br /> 4600 GUENTHER ROAD FOR A SAND AND GRAVEL PUMPING OPERATION — <br /> Carstensen stated she had some concerns regarding the terms being the same as they <br /> were 10 years ago, she read some of the regulations from contract. Carstensen stated <br /> that one thing she finds odd about this in the past and in today is after speaking with <br /> Terry and going through this is Part G regarding their recycled materials and storing <br /> them on location and the volume of materials, Carstensen stated she doesn't know what <br /> that volume is? She stated if they want to modify or add something in agreement to <br /> regulate amount of material being stored. <br /> Lancaster-stated she can clearly remember that when they discussed this conditional <br /> use permit she noted the Board room was full of parents that were concerned because <br /> of the school being very close to this area, and they originally had in mind the asphalt <br /> melt as well, Lancaster stated this was awful and these are some of the parameters that <br /> the parents really wanted listed in there. <br /> Quandt-stated he believed they had asphalt melting and that is what they were worried <br /> about, they put it in there to make sure it was a gravel operation and not tearing up <br /> highways and brining it there and grinding it, he stated that was reason why they left <br /> that in the contract. Mr. Quandt stated that when the Board gave them that conditional <br /> use permit someplace there was an estimate of how many tons were in that pile. <br /> Carstensen then stated that holding off for two weeks for more information and can <br /> issue in two weeks and can always back date the permit to March 17, 2020 which is <br /> when the other one expired, if that would be beneficial for everyone to have this out <br /> there and to clean up that little portion of it so everybody knows what the expectation is <br /> moving forward both Werner and Hall County. <br /> Lancaster-stated that was a great idea to hold up for two weeks and do a little more <br /> research on it. <br /> Quandt stated to Carstensen that it was his understanding that there was a question <br /> rather the board can regulate the number of vehicles <br /> Carstensen stated that she had some concerns, but does understand how and why they <br /> did it in the past, she had some documentation from Werner about them paying into Hall <br /> County, she stated that their operation has changed over the years, and at the time of <br /> agreement they did have vehicles that were in this area or housed here, and that may <br /> have been part of that agreement. Carstensen stated that her concern is these trucks <br /> are housed in other counties as well primarily Adams county, she stated the state statue <br /> as to where you pay your registration as to do with where you vehicles are primarily <br /> located, she thinks it would be odd to try and have them pay taxes in our county where <br /> we get a part of the proceeds, but deprive Adams county or some other county part of <br /> proceeds they would receive by way of a conditional use permit, she stated she had <br /> some real concerns with that. <br />
