RESOLUTION#19-e <br /> A RESOLUTION GRANTING AN APPLICATION BY SMART SOIL LLC THE <br /> CONDITIONAL USE OF A PART OF THE SOUTHEAST QUARTER(SE1/4) OF SECTION <br /> NINETEEN (19), TOWNSHIP ELEVEN(11) NORTH, RANGE ELEVEN(12) WEST OF <br /> THE 6TH P.M., HALL COUNTY, NEBRASKA. <br /> WHEREAS, Smart Soil LLC has made an application for a conditional use permit for the <br /> conditional use of the following-described property for the purpose of a composting site, all upon the <br /> following-described real estate, to-wit: <br /> THE SOUTHEAST QUARTER (SE1/4) OF SECTION NINETEEN (19), IN TOWNSHIP <br /> ELEVEN (11) NORTH, RANGE TWELVE (12), WEST OF THE 6TH P.M. IN HALL COUNTY, <br /> NEBRASKA; and <br /> WHEREAS, Applicant made a written application for a permit to use the above-described <br /> property for a composting operation involving paunch, sludge, and other organic materials; and <br /> WHEREAS, a public hearing regarding said application was held on the 10th day of <br /> December, 2019, after due and proper notice of same being afforded the public; and <br /> WHEREAS,the said property is located within the A-1 Agricultural Zoning District; and <br /> WHEREAS, the Hall County Board of Supervisors is empowered under the Hall County <br /> Zoning Resolution to grant a permit for the conditional use of the property for a composting site in the <br /> A-1 Agricultural Zoning District; <br /> NOW, THEREFORE, THE HALL COUNTY BOARD OF SUPERVISORS FINDS AS <br /> FOLLOWS: <br /> 1. The proposed use is consistent with land use specified for the A-1 Agricultural Zoning <br /> District. <br /> 2. Hall County is a Livestock Friendly County, and such a proposed use is compatible with <br /> such designation. <br /> 3. The location of this site appears to be environmentally sound for the proposed use. <br /> 4. The location of this site is in close proximity to a landfill, which has similar odor and <br /> nuisance considerations, making it compatible with the neighboring land usage. <br /> 5. The proposed use offers a solution to a waste control problem that the City of Grand Island <br /> and County of Hall have been contending with for more that forty years. <br /> 6. A trial period was conducted to explore the suitability of the proposal at the proposed site. <br /> Feedback received through the trial period indicates the proposal, including the location <br /> site, are compatible with its proposed use. <br /> 7. The proposed use is consistent with Hall County's comprehensive plan. <br /> NOW,THEREFORE,BE IT RESOLVED that the application for a conditional use permit for <br /> the conditional use of the above-described real estate for the above-stated uses should be and hereby <br /> is approved subject to the following conditions: <br /> Smart Soil LLC—Conditional Use Permit- Page 1 of 4 <br />
