Quandt made a motion and Peterson seconded to move forward with the Amick Acres flood <br /> project with the NRD taking the lead and the NRD at 1/3 Home Owners Association at 1/3 and <br /> Hall County at 1/3 up to $120,000.00 in in kind services and funding. <br /> Peterson requested to also have approval from The Army Corp of Engineers and use <br /> $36,000.00 out of the Road department line item for culverts. Quandt amended his motion and <br /> Peterson seconded to add this. <br /> Hartman stated they gave more money for the football stadium he withdrew his motion. <br /> Bredthauer stated those were CVB dollars and that is only pass through dollars from occupation <br /> taxes. <br /> Gary Hedman 349 Sunset Doniphan stated he stood and watched the water come down the <br /> ditch. This is a county road ditch and he expressed concern that it needed to be cleaned out. <br /> The county is responsible for the maintenance. The estimate on the county property is <br /> $182,000. The subdivision was built and approved but there was an obvious deficiency in the <br /> drainage plan. They take care of the roads because they are private roads but they pay the <br /> same tax rates. The county does not maintain their roads and they also pay the county to move <br /> snow so they are over paying in taxes. This is a small diversion plan. They are suffering from <br /> the flood damage and the insurance does not cover it and they had to pay to pump out the <br /> water. There is still a lot of damage prior to the flooding there was a wind storm. He noted the <br /> $51,000,000 in valuation and they will want to have their values reduced and that will affect the <br /> school system. The road is the county's responsibility and they need a commitment to take care <br /> of the roads. <br /> Hartman stated that $200,000 is not out of line. The County has to take care of the ditches and <br /> 740 acres drain into the county ditch they could get a petition to have the county take care of the <br /> ditch. He would move it to $150,000.00. <br /> Hartman made a motion and Richardson seconded to amend Quandt' s motion to $150,000.00 <br /> because there is a concern that they may have to wait on the NRD. She ask if someone would <br /> address the NRD issue. <br /> Larry Mulligan stated he talked to Mr. Miller and this is not a massive project to them it is small <br /> and he felt that the NRD would step in and do their fair share but he is only one person. Mr. <br /> Miller suggested to contact the NRD representative. They need a commitment from the county <br /> and the HOA has a commitment from the associations they hope they would get 1/3. <br /> Bredthauer questioned if the project was started without the NRD what would the liability be? <br /> She feels she need to help but we do not want to risk liability would it be possible for the HOA <br /> sign off? She expressed concern on the land that will be purchased would like to see it in <br /> writing. <br /> Deputy County Attorney Sarah Carstensen stated that it is hard to predict homeowners change <br /> and the HOA could change. There is risk on any type of work and we would have to do it to the <br /> best standards. Land will change over time and if the HOA buys the land then the maintenance <br /> issue would be different. The home owners would be responsible for their property and Hall <br /> County has the responsibility to maintain the roads. There is funding for those issues and it is <br /> part of their duty. <br /> 9 <br />
