RESOLUTION# 19- cA ldi <br /> A RESOLUTION TO RENEW A CONDITIONAL USE PERMIT FOR THE USE OF A TRACT <br /> OF LAND LOCATED IN THE EAST HALF (E 1/2) OF THE NORTHEAST QUARTER(NE 1/4) <br /> OF SECTION FIFTEEN (15),TOWNSHIP TEN(10) NORTH,RANGE ELEVEN(11) WEST OF <br /> THE 6TH P.M.,HALL COUNTY,NEBRASKA <br /> WHEREAS,Aurora Cooperative Elevator Company,hereinafter referred to as Aapplicant,@ is the lessee of <br /> a parcel of real estate containing 2.5 acres, more or less, depicted as Parcel 1 in Exhibit "A," which is <br /> attached hereto and incorporated herein by this reference and the owner of the parcel of real estate, <br /> containing 5.7 acres more or less, depicted as Parcel 2 in Exhibit "A," both parcels hereafter collectively <br /> referred to as the Aproperty@: and <br /> WHEREAS, applicant has made written application to use the property for the storage and retail sale of <br /> anhydrous ammonia, liquid and dry fertilizer and chemical products utilized for agricultural purposes and <br /> for storage of tanks and equipment related to the operation of a retail fertilizer and farm supply business; <br /> and <br /> WHEREAS, the above-described property is located in a district presently zoned for AG-1 Agricultural <br /> use; and <br /> WHEREAS, the proposed conditional use in a district zoned AG-1 is a permitted conditional use pursuant <br /> to section 5,paragraph 1.c. of the Zoning Resolution of Hall County, Nebraska,as amended; and <br /> WHEREAS, on November 26, 2019, a public hearing on said application was held by the Hall County <br /> Board of Supervisors upon due and proper notice of said hearing; and <br /> WHEREAS, at said public hearing the public was given the opportunity to speak in favor of and in <br /> opposition to the application for conditional use; and <br /> WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under the conditional <br /> uses within the AG-1 District;that such use, as limited herein, will not adversely affect the public interest; <br /> and that said Board is empowered under the Zoning Resolution to permit such conditional use. <br /> NOW BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County, Nebraska, the Hall <br /> County Board of Supervisors hereby authorizes the conditional use of the above-described property for the <br /> storage and retail sale of anhydrous ammonia, liquid and dry fertilizer and chemical products utilized for <br /> agricultural purposes and for storage of tanks and equipment related to the operation of a retail fertilizer and <br /> farm supply business subject to the following conditions: <br /> 1. The above-described real estate shall be used solely for the storage and retail sale of anhydrous <br /> ammonia, liquid and dry fertilizer and chemical products utilized for agricultural purposes and for storage <br /> of tanks and equipment related to the operation of a retail fertilizer and farm supply business. The <br /> premises shall be maintained in a neat and clean condition at all times,free of debris and inflammable waste <br /> materials. <br /> 2. Applicant shall comply with the Hall County Zoning Resolution with respect to the use of the <br /> above-described property. <br /> 3. The rights and privileges granted herein may be terminated for any act or acts of noncompliance with <br /> the terms and conditions of this resolution.
