Sarah Carstensen included information from the Attorney General's office regarding the class <br /> action suit on the opioid lawsuit. She stated that the county does not have to take action on this <br /> today Hall County does not have any cases involving this if the county was hard hit we may <br /> consider to opt out of the class action suit. Mr. Klein stated this is outside of the expertise of the <br /> county attorney. No action is required and it is yup to the county board what they want to do. <br /> C) BANKRUPTCY LITIGATION ASSISTANCE DISCUSSION & POSSIBLE ACTION TO HIRE <br /> OUTSIDE REPRESENTATION TO ASSIST WITH BANKRUPTCY MATTERS (POSSIBLE <br /> EXECUTIVE SESSION) — Sarah stated that this is an issue that is beyond the expertise of the <br /> county attorney and she has the name of an attorney that could handle these cases. She is <br /> asking for a blanket approval to use this attorney. The cases ae random and there could be <br /> more in the future. <br /> Richardson made a motion and Peterson seconded to approve hiring outside representation to <br /> assist with bankruptcy cases. Bredthauer, Hartman, Hurst, Lancaster, Quandt, Peterson, and <br /> Richardson all voted yes and none voted no. Motion carried. <br /> D) DISCUSSION & POSSIBLE ACTION REGARDING PERSONNEL NON-FMLA LEAVE <br /> DISCUSSION ON EXPECTATIONS <br /> E) PERSONNEL UPDATE ON ABILITY OF COUNTY/ELECTED OFFICIALS TO GRANT <br /> LEAVE WITHOUT REQUIRING USE OF SICK OR VACATION TIME IN LIMITED <br /> CIRCUMSTANCES County Attorney Marty Klein and Deputy County Attorney Sarah <br /> Carstensen and County Clerk Marla Conley and Bunny Schlick met and discussed the FMLA <br /> and the Non FMLA leave the Non FMLA is similar to the FMLA but there is no guidance <br /> regarding the length of time for this leave. The Health Plan Document on page 22 references a <br /> 90 day time frame for an employee that is on approved Non FMLA leave their lay off may <br /> continue for up to 90 days following the month the layoff occurs. The FMLA leave provides 12 <br /> weeks of coverage. <br /> Mr. Klein stated he appreciates the non FMLA but would like some guidance. They currently <br /> have a unique situation in his office and it is important to make this consistent and treat people <br /> the same way. Discussion was held and it was discussed to use the 90 day non FMLA and the <br /> FMLA the same time frame. <br /> Bredthauer made a motion and Quandt seconded to move forward with this and make it <br /> consistent with the FMLA policy. Bredthauer, Hartman, Hurst, Lancaster, Quandt, Peterson and <br /> Richardson all voted yes and none voted no. Motion carried. <br /> F) DISCUSSION & POSSIBLE ACTION REGARDING RESOLUTION SETTING SALARIES <br /> FOR COUNTY COMMISSIONERS & PUBLIC DEFENDER - Deputy County Attorney Sarah <br /> Carstensen requested that items f to be pulled and be addressed at the next meeting. <br /> G) DISCUSSION & POSSIBLE ACTION REGARDING RFP FOR PROSECUTOR CASE <br /> MANAGEMENT SYSTEM AND SET BID OPENING FOR DECEMBER 10, 2019 AT 9:15 A.M. <br /> Deputy County Attorney Sarah Carstensen stated she is still working on the RFP and will bring it <br /> back at the next meeting. Discussion was held and the board could still set the bid opening. <br /> Quandt made a motion and Bredthauer seconded to set the bid opening for the prosecutor case <br /> management system for December 10, 2019 a 9:15 a.m. with bids due December 9, 2019 at <br /> 5:00 p.m. Bredthauer, Hartman, Hurst, Lancaster, Quandt, Peterson, and Richardson all voted <br /> yes and none voted no.
