RESOLUTION#19- IJ C 5 A RESOLUTION TO RENEW A PERMIT FOR THE CONDITIONAL USE OF PART OF THE SOUTHEAST QUARTER OF SECTION THIRTY (30), TOWNSHIP TEN (10) NORTH, RANGE TEN (10) WEST OF THE 6TH PRIME MERIDIAN,HALL COUNTY, NEBRASKA. WHEREAS,Mid-Nebraska Aggregates, Inc. has made application to renew a conditional use permit, which permit was previously granted pursuant to Resolution #04-0027 of the Hall County Board of Supervisors, for the conditional use of the following real estate for a sand and gravel pumping operation, all upon the following described real estate, to-wit: Part of the Southeast Quarter, Section 30,Township 10 North,Range 10 West of the 6th RM., Hall County,Nebraska, more particularly described as follows: Beginning at a point on the East line of said Section 30, said point being 12.1 Feet South of the Southeast corner of the North Half of the North Half of the Southeast Quarter; thence Southerly along the East line of said Section 30, a distance of 800.7 Feet to the Northerly right-of-way line of Highway I-80; thence Southwesterly along said right-of-way line, a distance of 2,784.74 Feet to the West line of said Southeast Quarter; thence Northerly along the West line of said Southeast Quarter, a distance of 1,732.26 Feet to a point 12.1 Feet South of the Southwest corner of said North Half of the North Half of the Southeast Quarter; thence Easterly parallel to the South line of said North Half of the North Half of the Southeast Quarter, a distance of 2,624.02 Feet to the place of beginning and containing 76.165 acres, more or less; and WHEREAS, a public hearing regarding said application was held on the 28th day of May, 2019,after due and proper notice of same being afforded the public; and WHEREAS,the above-described real estate is located within the AG-1 Zoning District; and WHEREAS, the Hall County Board of Supervisors is empowered under the Hall County Zoning Resolution to grant a permit for the conditional use of the real estate for a sand and gravel pumping operation within the AG-1 Zoning District. NOW, THEREFORE, BE IT RESOLVED that the application for the renewal of the conditional use permit for the conditional use of the above-described real estate for the above-stated uses should be and hereby is approved for an additional period of five (5) years from and after June 11, 2019, subject to the terms and conditions as provided in the original Resolution#04-0027 not in conflict herewith.
