RESOLUTION #19- V 3 <br /> A RESOLUTION AMENDING RESOLUTION #19-020 TO CORRECT THE PHYSICAL <br /> ADDRESS OF THE REAL PROPERTY FOR A CONDITIONAL USE PERMIT AND <br /> RESCIND THE INCORRECT INFORMATION AS TO THE PHYSICAL LOCATION OF <br /> THE REAL PROPERTY FOR A CONDITIONAL USE PERMIT BY AMERICAN TOWER <br /> WHEREAS, American Tower has made an application for a conditional use permit for the <br /> conditional use of the following-described property for the erection, operation and maintenance of a <br /> monopole communications tower having a height of 69 feet, all upon the following-described real <br /> estate,to-wit: <br /> PART OF THE SOUTH ONE-HALF OF THE SOUTH ONE-HALF (S 1/2 S 1/2) OF <br /> SECTION SIXTEEN (16), TOWNSHIP TEN (10) NORTH, RANGE ELEVEN (11) WEST OF <br /> THE 6TH P.M., HALL COUNTY, NEBRASKA; and <br /> WHEREAS, a public hearing regarding said application was held on the 19th day of <br /> February, 2019, after due and proper notice of same being afforded the public; and <br /> WHEREAS, the said property is located within the AG-1 Agricultural Zoning District; and <br /> WHEREAS, the Hall County Board of Supervisors is empowered under the Hall County <br /> Zoning Resolution to grant a permit for the conditional use of the property for development and <br /> maintenance of a tower within the AG-1 Zoning District. <br /> WHEREAS, a prior resolution, #19-020 incorrectly listed the above address, <br /> NOW, THEREFORE, BE IT RESOLVED that the application for renewal of the permit for <br /> the conditional use of the above-described real estate for the above-stated uses should be and hereby <br /> is approved subject to the following conditions: <br /> 1. Maintenance. The premises shall at all times be maintained in a neat and orderly <br /> condition. The towers, antenna support structures, telecommunications facilities and <br /> antennas shall at all times be kept and maintained in good condition, order and repair <br /> so that the same does not constitute a nuisance to or a danger to the life or property of <br /> any person or the public. <br /> 2. Noxious Weeds. Noxious weeds on the premises shall be controlled pursuant to state <br /> and local laws and regulations. <br /> 3. FAA and FCC Compliance. The tower owner shall comply with all applicable rules <br /> and regulations of the Federal Aviation Administration regarding the construction, <br /> height, design and maintenance of the communications tower placed upon the above- <br /> described real estate and applicable rules of the Federal Communications Commission <br />
