Upon issuance of a Notice to Show Cause by Hall County, the tower owner shall have thirty (30) days to show by a preponderance of the evidence that the tower has been in use or under repair during the period of apparent abandonment. In the event the tower owner fails to show that the tower has been in use or under repair during the relevant period, Hall County shall issue a final determination of abandonment of the site and the tower owner shall have seventy-five (75) days thereafter to dismantle and move the tower. 14. Term. The term of the permit shall be for a period of five (5) years from the date hereof unless terminated pursuant to Paragraphs 13 or 15. This permit shall run with the land during the permit's duration and may be transferred, conveyed and assigned by the applicant to assigns and successors-in-interest. 15. Termination of Permit. The County of Hall, Nebraska may terminate this permit in the event that tower owner fails to comply with any of the conditions, restrictions and obligations set forth herein. The Hall County Board of Supervisors shall notify the tower owner in writing setting forth the specific area of noncompliance. If the tower owner fails to take reasonable action to comply with the notice of noncompliance and correct any or all violations within 30 days after receiving said notice, the Hall County Board of Supervisors shall hold a hearing to consider the revocation and termination of the Conditional Use Permit by majority vote.
