A <br /> letter of rejection as per LB. 37A 77-3502 was sent to Ms. Layher. A letter requesting a <br /> hearing was received February 5, 2014. The application was not approved because <br /> they were not living in the residence. <br /> Cynthia Lindley requested to address the board. She stated her father is deceased and <br /> mother was moved to a nursing home until her application to the VA is accepted. She <br /> has been accepted to go to the VA but is now on a waiting list. Mrs. Layher fell and <br /> they were concerned for her safety. Ms. Lindberg stated that she takes care of her <br /> mother's affairs and all of her mail is forwarded to her. She is asking the board to <br /> reconsider the application because it is a short stay at the care home <br /> Ms. Pelland asked if the board had any questions. Mr. Lanfear asked if the law allows <br /> the home to be vacant if it is not rented or leased to someone else. Ms. Pelland stated it <br /> has to be with the intention to return to the home and that the care home is short term. <br /> The board would have to determine if it is the intent to return to the home for 2014 and if <br /> that is the case the home stead is reimbursed from the state. If the board would <br /> authorize the exemption that does not meet the state regulations the state would not <br /> return the money and the county would have to make up the difference. The application <br /> is in Mr. Layher's name <br /> Mr. Lanfear state that she had an injury and would be in recuperating so he feels it <br /> qualifies. <br /> Lanfear made a motion and Purdy seconded to approve the exemption application. <br /> Lancaster stated she was sorry for her loss and the situation. She asked Cynthia if <br /> there was any intent that she could return to the home and she stated that she was <br /> scared after she fell and they did not consider sending her back to the home they <br /> wanted her to be safe. <br /> Arnold stated this is difficult the state statute is specific. <br /> Lancaster stated the board needs to look at the issues a family member is now living in <br /> the home. <br /> Arnold stated that the intent is once they are deceased they do not need the exemption <br /> or if they move out and put the home up for sale. The intent is to prevent taxpayers <br /> subsidizing taxes. <br /> The vote on the motion to approve the exemption was taken. Arnold, Lancaster, <br /> Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none voted no. <br /> Motion carried. <br />
