Ms. Carstensen stated that the board has to decide, when DHHS took on the welfare programs <br /> they requested the space and that space was 5200 to 5500 square feet but it appears now it <br /> has increased so what is the right amount. The county has made repairs. The state statute <br /> does not say it has to be ADA compliant in an old building and you would not have to be <br /> compliant to the new ADA regulations. <br /> Discussion was held and there were the issues that DHHS noted the ADA compliance the <br /> HVAC and the life safety issues but people can disagree on what is compliant. Bredthauer ask <br /> if they could make the county pay the rental costs and Ms. Carstensen stated they could sue us <br /> but we could demonstrate they we have complied. She also stated that there is a greater risk <br /> the County could be sued if we do not address the ADA issues. <br /> Richardson questioned what the financial expectation is of Hall County. She noted that DHHS <br /> did state the county would not have to pay to move them. Mr. Humphrey addressed some of <br /> the issue DHHS noted. <br /> • The height of the restroom counter is the correct height he showed a picture <br /> • The pipes that are exposed could have a box built around them <br /> • The mirror is at the correct height <br /> • There is a fresh air duct and this is compliant and passed the code <br /> • There is a fresh air duct to the boiler and the boilers are inspected annually and they <br /> passed inspection <br /> He also stated that according to ADA regulations unless the building is remodeled we would be <br /> in compliance. They are also still working on getting the building balanced and there is part of <br /> the HVAC that is old and needs to be replaced. Mr. Humphrey showed pictures of the areas. <br /> Discussion was held on what ADA compliance the county would have to comply with. <br /> Bredthauer questioned who would have to pay for anther inspection if it has to be done and <br /> expressed concern that they may not be patient. <br /> Ms. Carstensen stated that she will do some research to determine what is compliant. This <br /> could be an undo financial burden and she will research the case law. <br /> Lancaster expressed concern that there a number of details and they have not been <br /> professional regarding this process. They have agreed to a phone conference this week and <br /> discussion was held to tape the conversation as long as they would agree to it. We need to <br /> assess the ADA standards and to the inspection. If the county is forced to pay rent then we <br /> should have adequate options to find space. This need to be addressed. <br /> Arnold made a motion and Lanfear seconded to take the position that the current Pine Street <br /> location is in compliance with ADA regulations and the space will continue to be available for <br /> DHHS. <br /> Arnold expressed concern that they jumped the gun thinking they could get new space but they <br /> did not include the county we have no reason to relocate and we do not know why the current <br /> location is not acceptable. We need to take the position we are in compliance and they need to <br /> point out where we are not. There is no communication on specific issues and they need to <br /> work with the county. . <br /> Schuppan stated he agrees and the county needs the change to bring the building in <br /> compliance. <br /> 6 <br />
