RESOLUTION#18 0 l 5 - A RESOLUTION AUTHORIZING A CONDITIONAL USE OF LOT ONE (1) ON ISLAND IN SECTION TEN(10),TOWNSHIP TEN(10)NORTH, RANGE TEN(10)WEST OF THE 6TH P.M.,HALL COUNTY,NEBRASKA WHEREAS, Platte Valley Communications, hereinafter referred to as "Applicant," is the lessee of the following-described property,to-wit: LOT ONE (1) ON ISLAND IN SECTION TEN (10), TOWNSHIP TEN (10) NORTH, RANGE TEN(10) WEST OF THE 6TH P.M., HALL COUNTY,NEBRASKA; and WHEREAS, Applicant has filed a renewal application for the conditional use of the above- described property for the erection and maintenance of a radio communications tower not to exceed four hundred feet (400') in height and for the erection of a building not to exceed three hundred sixty square feet(360')total floor space; and WHEREAS, a public hearing on said renewal application was held by the Hall County Board of Supervisors on April 3, 2018, following due and proper notice of said application and hearing; and WHEREAS,the aforesaid use is consistent with the intent of the agricultural district within which the aforesaid property is located. NOW, THEREFORE, BE IT RESOLVED that the application for conditional use of the above- described property for the above-stated uses should be the same and hereby is approved subject to the following conditions: 1. The premises and the facilities thereon shall at all times be maintained in a neat and orderly condition. 2. Noxious weeds on the premises shall be controlled pursuant to state and local laws and regulations. 3. Applicant shall comply with all rules and regulations of the Federal Aviation Administration regarding the construction, height, design and maintenance of the communication tower placed upon the above-described property. 4. Said tower shall be used for communication purposes only. 5. The term of the permit shall be for a period of five (5) years from the date hereof unless terminated pursuant to paragraph 6. 6. The County of Hall, Nebraska may terminate this permit in the event that applicant fails to comply with any of the conditions, restrictions and obligations set forth herein. The Hall County Board of Supervisors shall notify the applicant in writing setting forth the specific area of noncompliance. If the applicant fails to take reasonable action to comply with the notice of noncompliance and correct any or all violations within 30 days after receiving said notice, the Hall County Board of Supervisors shall hold a hearing to consider the revocation and termination of the Conditional Use Permit by majority vote.
