A RESOLUTION PERMITTING THE CONDITIONAL USE OF CERTAIN PROPERTY LOCATED IN THE NORTHEAST QUARTER OF THE EAST ONE HALF OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION SIXTEEN,TOWNSHIP TEN NORTH, RANGE TEN,WEST OF THE 6TH P.M.IN HALL COUNTY,NEBRASKA. WHERE A S, Darling mg Inte motional hereinafter referred to as "applicant," is the owner of property in Hall County,Nebraska,to-wit: The Northeast Quarter (NE 1/4) of the East One Half(E 1/2) of the Northwest Quarter (NW 1/4) of the Northeast Quarter (NE 1/4) of Section Sixteen (16), Township Ten (10) North, Range Ten (10), West of the 6th P.M. in Hall County,Nebraska; and WHEREAS, applicant has filed its renewal application to continue its use the above-described property for operating an animal rendering plant; and WHEREAS, the property is located in an AG 1 Agricultural Zone in Hall County, Nebraska, and the requested use may be permitted as a conditional use pursuant to the Hall County Zoning Resolution; and WHEREAS, applicant has further requested to use the above-described property for the placement of a mobile home to be used by applicant as an office for applicant's animal rendering plant; and WHEREAS,the Hall County Board of Supervisors held a public hearing at its regular meeting on April 3,2018,on permittee's renewal application following published notice of said public hearing; and WHEREAS, the Hall County Board of Supervisors finds that the requested conditional use will not adversely affect the public interest, and that said Board is empowered under the Zoning Resolution to grant said conditional use; and WHEREAS, the Board finds that compliance with the specific rules governing individual conditional uses will be satisfied by compliance with the conditions contained herein and set forth below. NOW, THEREFORE, BE IT RESOLVED, pursuant to the powers granted under the Zoning Resolution as adopted by the Board of Supervisors of Hall County, Nebraska, the Hall County Board of Supervisors, hereby grants to Darling International, a Conditional Use Permit to use the above-described real estate for the purpose of operating an animal rendering plant, subject to the following conditions, restrictions and limitations: 1. The above-described said real estate must, at all times, be kept in a clean, neat and orderly condition. 2. No carcasses of dead animals, offal, spoiled meats, or putrid animal substances shall be placed or stored upon the real estate in such a way as to create an unreasonable hazard or nuisance to adjacent landowners or to the general public. 3. No uses under this Conditional Use Permit shall result in air, water or groundwater pollution that creates an unreasonable hazard or nuisance to the adjacent landowners or to the general public.
