7. DISCUSSION AND POSSIBLE ACTION REGARDING FORCED WEED SPRAYING - <br /> Schuppan stated at the last board meeting reported that there were phone calls regarding an <br /> issue with noxious weeds. He met with County Attorney Jack Zitterkopf, Weed Superintendent <br /> Rob Schultz and they issued a 10 day notice on the various properties to address the spraying. <br /> Rob stated he talked to Mr. Stueven and there were several voice messages. He looked at the <br /> property this morning but no action had been taken. There is someone that is interested in <br /> renting 442 acres so those acres would not have to be sprayed. He has 3 quotes and one <br /> company did not want to get involved. Yesterday was the 10th day and action can be taken. <br /> Francis Hannon with the Weed Board was present and stated it is state law and usually Rob is <br /> able to get these type of issues taken care of. It is hard to have to take this route but the <br /> properties need to be sprayed because of the noxious weeds. <br /> Quandt ask how many properties and Rob stated there are 10 if the 3 have been rented. He <br /> questioned if it was still in bankruptcy. <br /> County Attorney Jack Zitterkopf stated that he contacted the attorney that is representing Mr. <br /> Voss and it has been released and he also contracted Mr. Stuven's attorney and received the <br /> same response. It is a san issue and he did take a call from Mr. Stueven and tried to convince <br /> him that the bankruptcy does not have any interest in the property and tried to encourage him to <br /> take care of the weed problem but Mr. Stuven continued to say they would not allow him to do <br /> anything with the property. <br /> Lanfear state he does not understand and states he does not have the money and basically is <br /> going to ignore the law. This is causing harm to his neighbors. <br /> Arnold stated that Steve took him on a tour of the properties that are affected and during that <br /> time they called one of the neighbors and the neighbor was not happy. This needs to be taken <br /> care of right away to address any future problems there is already damage that has been done. <br /> Discussion was held if would be necessary to declare this an emergency to authorize the funds. <br /> Schuppan stated that this is a serious problem and the county can put a tax lien on the property <br /> to recover the cost of spraying the properties. <br /> Bredthauer stated it may even be too late it needs to be done. She also questioned if the <br /> quotes could be done in the next few days. <br /> Quandt stated he supports this and questioned where the funds would come from discussion <br /> was held to pay the cost from miscellaneous general, miscellaneous line item. Lancaster stated <br /> she will check with Stacey. Arnold stated that this will be paid from the new fiscal year budget it <br /> was a cost that was not anticipated. Rob stated he estimated it would be about 1000 acres and <br /> he does have 3 quotes. Quandt stated that they could still plant a crop of beans. <br /> Schuppan made a motion to proceed with the forced spraying on the 9 properties on about 1000 <br /> acres. Rob has 3 quotes regarding the cost. <br /> Zitterkopf stated one primary thing in the motion is to move that the county board declare <br /> spraying the noxious weeds an emergency and authorize Rob Schultz to spray the noxious <br /> weeds. Discussion was held to include all of the properties in the even that some are not <br /> rented. <br /> 6 <br />
