Section 3. Funding. County shall provide to Industries such funds as County receives from <br /> the State of Nebraska, Department of Roads pursuant to an application for funding as <br /> described in Section 1,above. Nothing contained herein shall be construed or interpreted to <br /> require County to provide additional funds to Industries for such purposes except such funds <br /> which County has agreed or may in the future agree to provide pursuant to County's <br /> application or application to the Nebraska Department of Roads for partial funds of a public <br /> transportation system and for which County, by and through its County Board of <br /> Supervisors,appropriates funds for such purposes.Industries agrees to provide to the Hall <br /> County Board of Supervisors,on or before June 30,2018, an accounting for the use of the <br /> funds so appropriated for transportation operations and, in the event that any part of the <br /> County's appropriated funding for transportation operations is in excess of the amount <br /> required to meet State and Federal guidelines commonly referred to as the "local match," <br /> that excess funding will be returned to the County. Industries will use its best efforts to <br /> secure from additional sources funding for the aforesaid public transportation system to the <br /> extent authorized by the applicable law and regulations. Such funds may include sources <br /> such as but not limited to,fares from riders,funds from local political subdivisions and <br /> agencies, donation, gifts,and bequests. <br /> Section 4. Obligations of Industries. To the extent not inconsistent with this agreement, <br /> Industries shall perform each and every condition,obligation, and responsibility required <br /> of County pursuant to the current "Agreement between Hall County and the State of <br /> Nebraska Department of Roads for Partial Funding of a Transportation System" or any <br /> subsequent agreement as agreed to by the parties. Said conditions, obligations,and <br /> responsibilities shall include, but shall not be limited to,project financial accounting and <br /> administration requirements; preparation and submission of audits; prohibited interests; <br /> compliance with applicable labor and civil rights legislation and rules;compliance with the <br /> requirements set out in exhibits "A", "B","C",and "D"which are attached hereto and <br /> incorporated herein by this reference as though fully set forth; compliance with 49 C.F.R. <br /> Part 604 and 605 regarding charter bus operations and school bus operations; and <br /> compliance with federal and state drug free workplace requirements. <br /> Section 5. Assignments and Subcontracts. Industries shall not assign this agreement <br /> nor enter into any subcontracts for any of the services provided for in this agreement <br /> without the prior written consent of the County and the Nebraska Department of Roads. <br /> Section 6. Amendments. The parties may make adjustments to the work and services to <br /> be performed under this agreement after consultation with and approval by the Nebraska <br /> Department of Roads. Revision in the content of this agreement made necessary or desirable <br /> due to changes or modifications in any subsequent agreement between County and the <br /> Nebraska Department of Roads shall be negotiated in good faith by the parties hereto upon <br /> the request of either party. In the event that the parties are unable to agree upon an amended <br /> agreement,the party requesting the amendment of change may terminate this agreement by <br /> giving 30 days prior written notice to the non-terminating party. <br /> Section 7. Insurance. Industries shall maintain in amount and form satisfactory to County <br /> such insurance as will be adequate to protect the project equipment and facilities <br /> throughout the period of contract performance. The insurance shall consist of collision, <br /> comprehensive and liability coverage of not less than the following amounts: <br />
