PUBLIC PARTICIPATION — Chairman Lancaster called for public participation and no one <br /> responded. <br /> 5 COUNTY ATTORNEY— DISCUSSION & POSSIBLE ACTION ON INTERLOCAL <br /> AGREEMENT WITH SARPY COUNTY FOR SARPY COUNTY TO PROVIDE SECURE <br /> JUVENILE DETENTION ON AN "AS NEEDED" BASIS —County Attorney Jack Zitterkopf <br /> explained that when there is a juvenile that requires a secure facility they use the facility in <br /> Madison County. If there is a situation that arises and they do not have room they need to <br /> have a facility to send them to. He has an interlocal agreement with Sarpy County to take <br /> juveniles in need of a secure detention. They charge $210.56 per day and that is a large <br /> number but Lancaster County charges $270.00 per day. This would be only if there is an <br /> overflow. Connie Hultine is present if the board has any questions. <br /> Lancaster stated that it is necessary to have a facility if they need to be detained. <br /> Lanfear made a motion and Quandt seconded to authorize the chair to sign the interlocal <br /> agreement with Sarpy County to provide secure juvenile detention. Arnold, Bredthauer, <br /> Lancaster, Lanfear, Quandt, Richardson and Schuppan all voted yes and none voted no. <br /> Motion carried. <br /> 1a) DISCUSSION & POSSIBLE ACTION ON A LETTER TO THE POSTAL REGULATORY <br /> COMMISSION PROTESTING THE POSTAL SERVICE DECISION - Lanfear stated that he is <br /> not giving up on this issue. The postal service did not play by the rules because they did not <br /> provide information regarding the appeal process regarding their decision. He has a letter that <br /> he would like to have the chair sign and send. <br /> Lanfear made a motion and Quandt seconded to authorize the chair to sign the letter. <br /> Lanfear stated that it is important to have a place to sell stamps and pick up the accountable <br /> mail that is mail that needs to be picked up and signed for. Arnold, Bredthauer, Lancaster, <br /> Lanfear, Quandt, Richardson and Schuppan all voted yes and none voted no. Motion carried. <br /> 4A) 9:30 A.M. PUBLIC HEARING —TO CONSIDER THE SITING APPLICATION FOR O'NEILL <br /> WOOD RESOURCES, LLC FOR A CONSTRUCTION & DEMOLITION WASTE DISPOSAL <br /> AREA - Quandt made a motion and Arnold seconded to open the public hearing. Arnold, <br /> Bredthauer, Lancaster, Lanfear, Quandt, Richardson and Schuppan all voted yes and none <br /> voted no. Motion carried. <br /> Regional Planning Director Chad Nabity and Loran Humphrey were present. This is the <br /> requirement of the DEQ to hold a public hearing on the siting application and after the hearing <br /> and a 30 day waiting period for public comment, a decision can be made. Mr. O'Neill has an <br /> option on the property and if all of this is approved he will move forward. We were hoping to <br /> hold the public hearing for the conditional use permit at the same time but the legal ads for the <br /> siting application and the conditional use permit were similar and the siting application ad ran <br /> twice so the conditional use permit hearing was not advertised properly. Mr. O'Neill would like <br /> to hold the hearing for the conditional use permit for June 13, 2017 which is after the 30 days. It <br /> makes sense that it would come back at the same time for approval. This is a similar process <br /> that will be followed for Heritage Disposal. Mr. O'Neill and his attorney are present to present <br /> the case. <br /> Stephen Mossman, Attorney with Mattson Ricketts Law Firm, Lincoln Nebraska was present. <br /> Mr. Mossman asked for a few minutes to allow the court reporter to set up equipment in order to <br /> 3 <br />
