Schuppan stated that he is aware of the conservation easement they have 40 acres that are in a <br /> conservation easement. This is not for commercial development and this piece of land has had <br /> a home on it forever. <br /> Mr. Nabity stated he is familiar with this and Ms. Woods contacted him and Jerry Janulewicz <br /> has been working on this. They want to make sure that they can replace the old house on this <br /> 13 acre tract. All of the other tracts are 20 acres. <br /> Lancaster stated that is important to make it clear that they can rebuild the house. <br /> Ms. Beth Woods stated that she took this to the City Attorney and ask if the home were hit by a <br /> tornado would they be able to rebuild and according to the current the easement does not <br /> specifically provide authorization to use the 13 acre tract for a single—family home. They were <br /> able to get all of the parties to sign off on the amendment and the <br /> City has approved it and they are hoping that the County Board will also approve it. The <br /> purpose is to make sure that they can rebuild a home if the old home is torn down. <br /> Schuppan made a motion and Lanfear seconded to approve Resolution #17-017 A Resolution <br /> of Concurrence to the amendment of a Conservation Easement. Arnold, Bredthauer, Lancaster, <br /> Lanfear, Quandt, Richardson and Schuppan all voted yes and none voted no. Motion carried. <br /> 5 <br />
