9:05 Held a Board of Equalization meeting. <br /> 9:41 a.m. Adjourned the Board of Equalization meeting and returned to the regular meeting. <br /> 6. COUNTY ATTORNEY— DISCUSSION REGARDING THE ZONING COMPLIANCE OF C & I <br /> CATTLE COMPANY & SPENCER-WILL INC., AND POSSIBLE ACTION REGARDING THE <br /> SAME —County Attorney Jack Zitterkopf stated that the board approved hiring another attorney <br /> and he introduced Thomas Helget. Mr. Helget stated he was born in Germany and his father <br /> was a JAG attorney. His father is a federal judge in Huston and his wife is an attorney in <br /> Lincoln. He stated he wanted to be a prosecutor and is excited to be here and serve Hall <br /> County. <br /> Jack also reminded the board chair when she is appointing committee members that there will <br /> need to be an appointment from the county board to serve on the drug court board. He read the <br /> list of the members that are to serve on the drug court board. <br /> COMPLIANCE OF C & I CATTLE COMPANY & SPENCER-WILL INC. —Jack stated that he <br /> does not expect any board action today but he wanted to clarify this issue. In December there <br /> were 2 complaints about C & I Cattle Company and that there were too many cattle. This has <br /> been an issue for over a year and he does not investigate issues. He had informed the board <br /> that he could take legal action without the board's action and some thought he was out of line <br /> and now he has reconsidered that opinion. It is his duty to uphold the constitution of the United <br /> States and the Constitution of the State of Nebraska but the does not extend to zoning <br /> resolutions. Any action to enforce that resolution would be up to the Hall County Board of <br /> Supervisors. He has no intension to do anything until he receives instructions from the board to <br /> proceed. The Chair could instruct him to take action or they can do nothing and wait for <br /> neighbors to take action but we could face legal fees and the cost of damages <br /> Considering the zoning regulations he wants the board to be aware that he is not leading this <br /> but mostly there are complaints that there are too many cattle and they would have to obtain a <br /> conditional use permit. <br /> Lancaster stated she appreciates that he has brought it forward and now there is a committee at <br /> Regional Planning to address this. <br /> Quandt stated he did receive some phone calls and was told they are in compliance. Jack <br /> noted that last fall Mr. Kohloff lead us to believe that he was in compliance the 2 lots were under <br /> 1000 head so a conditional use permit was not required. He currently has a number of cattle on <br /> corn stock so that count is not included. Quandt stated that in the last 24 or 48 hours he is in <br /> compliance. <br /> Mr. Humphrey stated he talked to Mr. Kohloff and Loran showed pictures of the cattle that are <br /> on corn stocks and pictures of the feed lot pens and there are very few cattle in the lots. <br /> Mr. Kohloff stated that the way his operations works there could be over 1000 head but he <br /> brings cattle in treats them and then ships them to other feed lot. There are cattle coming in <br /> and going out all the time. Right now the cattle are on the corn stocks. The other pen runs the <br /> same way and there is an agreement with Mr. Kohloff they use his equipment and address the <br /> waste. <br /> 5 <br />
