PUBLIC PARTICIPATION — Chairman Arnold called for public participation and o one <br /> responded. <br /> 10:16 A.M. Held a Board of Corrections meeting. <br /> 10:30 a.m. recessed the Board of Corrections meeting to hold the public hearing. <br /> 6A) 10:30 A.M. PUBLIC HEARING ON PROPOSED NEW COUNTY ORDINANCE <br /> GOVERNING PUBLIC NUDITY AND LEWD AND LASCIVIOUS BEHAVIOR (TABLED FROM <br /> OCT. 20 BOARD MEETING). —Quandt made a motion and Lancaster seconded to open the <br /> public hearing. . Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all <br /> voted yes and none voted no. Motion carried. <br /> Attorney Vincent Valentino was present. This public hearing is in conjunction with the public <br /> hearing for the zoning regulations and the zoning regulations will need to be approved first. The <br /> public hearing on the proposed county ordinance was recessed. <br /> 6 B)10:30 a.m. Public Hearing on zoning amendment proposal of Hall County Board of <br /> Supervisors regarding possible amendments to the Zoning Regulations of Hall County, <br /> Nebraska, pursuant to Article 10, Section 10.01 of the Hall County Nebraska Zoning <br /> Resolution #04-0020. The proposed amendments relate to definitional sections and <br /> regulations for adult establishments and the land available to adult establishments as a <br /> permitted use, in AG-SI Special Agriculture/Industrial Zone, AG-SE Agriculture/Events <br /> Zone, LI Light Industrial District, and G-I General Industrial District, as well as <br /> harmonizing general penalty provisions in the existing regulations. The proposed <br /> amendments would affect Sections 2.03A, 2.03.11 through 2.03.20, 2.03.269, 2.03.389, <br /> 2.03.390, 4.06.01, 4.06.02, 4.07.01, 4.07.02, 4.14.01 to 4.14.03 (paragraph 5), 4.15.01 <br /> to 4.15.03 (paragraph 13), 6.08, 10.02, 10.03, and 11.01 of the existing regulations, and <br /> would add a new Section 3.29 Adult Entertainment Regulations, and a new Section 7.06 <br /> Remedies for Violation, Penalties, and Enforcement Generally. A copy of the full text of <br /> all proposed amendments is available at the Hall County Regional Planning Department <br /> Office and the Hall County Clerk's Office. <br /> Lancaster made a motion and Lanfear seconded to open the public hearing on the zoning <br /> regulations. Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted <br /> yes and none voted no. Motion carried. <br /> Mr. Valentino stated that on August 25, 2015 there was a presentation by Scott Bergthold on <br /> the secondary effects of a sexually orientated business and the packets were provided to the <br /> county board and to regional planning and will be part of the official record there was a <br /> significant study that was done and the regulations are permissible. The changes were <br /> significant and the updates are needed. There was considerable study done to the zoning <br /> maps and the regulations that have been proposed are important. The proposals are important <br /> to this county and other counties to regulate sexually oriented businesses. He would suggest to <br /> move forward with the approval with the various presentations that have been given to this <br /> board and regional planning and to proceed with the final adoption of the zoning resolution and <br /> after that then move forward to the lewd and lascivious behavior ordinance. There is also a <br /> requirement that there is to be two additional readings of the resolution and the ordinance. The <br /> board has gone through several hearings and if the board feels comfortable with the <br /> 3 <br />
