Lancaster asked what she is asking for. <br /> Ms. Bohan is asking for the responsible thing for the board to do, if property is adjoining to an <br /> EPA cleanup site then they should request an EPA study. Other states require it for the safety <br /> of people and possible liability issues. It is not unreasonable to request an EPA study to make <br /> sure that there are not water issues in the future. It is common sense to cover this <br /> Lanfear said he thought the water in that area was tested and asked if it was documented and <br /> studied. <br /> Chad Nabity stated the site she is talking about is to the east the river and ground water flows to <br /> the north east so it would flow to the crane meadow area. <br /> Arnold stated this agreement is between EPA and Nebraska DEQ it is only a highlighted site <br /> Nebraska EPA is in charge of what is done and that will not affect what they do today. They <br /> would still be required to follow the regulations. Ms. Bohan stated she thinks there would be a <br /> difference. <br /> Arnold stated they were aware of the old gas station and did not receive any documentation. <br /> The ownership has been transferred to the Crane Center. <br /> Ms. Bohan asked if this would be a reasonable site for a conditional use permit and if approved <br /> there could be liability issues in the future. <br /> Lancaster has some concern because she lived in Capital Heights when there were <br /> contamination issues. This issue has not come up before and there has been a lot of effort to <br /> come to a common agreement. She also noted that CAAP still has a cleanup site. <br /> Mr. Nabity stated that the Army Corps of Engineers has strict covenants on the property if and <br /> when it is sold. The treatment that the army uses is to use air and light, that is the most <br /> common way to treat contamination. <br /> Lancaster questioned if it is reasonable to ask an expert. Mr. Nabity stated this is not impacting <br /> the surrounding properties at this time only that property. They are not disturbing the soil on the <br /> contaminated site. <br /> Arnold stated a reasonable man would trust the environmental entities that have oversight and <br /> would assume that they would address the issues. <br /> Ms. Bohan asked if Vontz disclosed this information. Arnold stated the Nebraska DEQ knows <br /> about this site and they would pay attention to the adjoining property the EPA could intervene if <br /> it was necessary to keep the area safe they are responsible. <br /> Quandt asked if it would it make sense to pass contingent on DEQ approval. Mr. Nabity asked <br /> what kind of approval from DEQ? They do no approve sand and gravel permits. <br /> Sean Vontz stated that they have the approval from the Corps of Engineers. They have an <br /> engineering firm that gets all of the documentation ready to send to the corps for approval. <br /> Mr. Zitterkopf stated that there is a motion and a second for the approval of a conditional use <br /> permit and he also noted that this conditional use permit is different than the one from 2 weeks <br /> 4 <br />
