Purdy made a motion and Schuppan seconded to open the public hearing for the liquor license <br /> for Fatdogs. Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted <br /> yes and none voted no. Motion carried. <br /> Chairman Arnold called for public participation and no one responded. This is a new application <br /> for a liquor license. Purdy read the letter from Chief Deputy Chris Rea and he stated found no <br /> reason to not approve this application. <br /> There were no questions or concerns. <br /> Purdy made a motion and Lanfear seconded to close the public hearing. Arnold, Lancaster, <br /> Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none voted no. Motion <br /> carried. <br /> Lanfear made a motion and Purdy seconded to approve the liquor license for Fatdogs Grand <br /> Island. Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and <br /> none voted no. Motion carried. <br /> 10. DISCUSSION & POSSIBLE ACTION REGARDING APPLICATION FOR CONDITIONAL <br /> USE PERMIT FOR DOUGLAS & NANCY STANGE TO OPERATE A LIVESTOCK TRAILER <br /> WASHOUT FACILITY- County Attorney Jack Zitterkopf stated that this application resembles <br /> an application that the board turned down on the same use and location on June 16, 2015 and <br /> Resolution 15-025 was approved stating that when you cannot assemble a majority because of <br /> a conflict of interest on an issue it is to be referred to regional planning. This would be a motion <br /> that because we have a conflict of interest on the application that it be forwarded to Regional <br /> Planning. Mr. Zitterkopf read the resolution. <br /> Schuppan made a motion and Lanfear seconded to forward this application to the Regional <br /> Planning Commission because of a conflict of interest. Mr. Nabity was present and stated that <br /> the Planning Commission will hold the public hearing and this would not be a recommendation <br /> but a decision and could be subject to challenge and could go to district court. <br /> Lancaster stated she appreciated the explanation and it makes it clear there is a conflict. <br /> Arnold stated if the board did not do this it would open us up for further litigation. <br /> The vote on the motion to forward this to Regional Planning was taken. Arnold, Lancaster, <br /> Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none voted no. Motion <br /> carried. <br /> COMMITTEE OR BOARD MEMBER'S REPORTS — Lancaster stated that at MAAA they looked <br /> at some proposed changes in the FLSA standards for exempt employees and there could be <br /> some issues regarding overtime. She noted that at the NIRMA conference that is scheduled for <br /> October 8 and 9 there is to be information regarding recent FLSA changes regarding the rule for <br /> exempt employees and that this potential change could impact counties on overtime for salaried <br /> or exempt employees. Lancaster requested information for salaried employee in Hall County. <br /> Purdy stated that he will bring back information. <br /> Chairman Arnold called for any other reports and no one responded. <br /> 5 <br />
