PUBLIC PARTICIPATION — Chairman Arnold called for public participation and no one <br /> responded. <br /> COUNTY ATTORNEY - County Attorney Jack Zitterkopf was present and stated that the <br /> attorney for the defense counsel will be here at 10:00 a.m. and the candidates for the interim <br /> corrections director will be her at 11:00 a.m. <br /> 6. APPROVE SPECIAL AUDIT FOR CORRECTIONS DEPARTMENT—Quandt made a motion <br /> and Lancaster seconded to approve a special audit for the corrections department. Arnold, <br /> Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none voted no. <br /> Motion carried. <br /> Lancaster stated that this is a good practice and has been done in the past it may only be for a <br /> short period of time but it would contain all of the same requirements. <br /> 16. EXECUTIVE SESSION — DISCUSSION REGARDING PENDING LITIGATION - Quandt <br /> made a motion and Lancaster seconded to go into executive session. Quandt requested that <br /> Judy Wiegert and Mark Bonser be included at separate times. There are 2 reasons for an <br /> executive session to protect the public interest or to prevent needless harm or injury to an <br /> individual. Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes <br /> and none voted no. Motion carried. <br /> 9:21 a.m. executive session <br /> 10:16 a.m. Quandt made a motion and Lancaster seconded to recess this executive session <br /> until later in the meeting. Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and <br /> Schuppan all voted yes and none voted no. Motion carried. <br /> 4.10:17 a.m. COUNTY ATTORNEY - <br /> a) Executive Session — DISCUSS STRATEGY REGARDING PENDING LITIGATION WITH <br /> DEFENSE COUNSEL, Harrington v. Hall County, et. al., US District Court Case No. 4:15cv3052 <br /> — Lancaster made a motion and Quandt seconded to go into executive session regarding <br /> pending litigation with defense counsel. There are 2 reasons for an executive session to protect <br /> the public interest or to prevent needless harm or injury to an individual. Arnold, Lancaster, <br /> Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none voted no. Motion <br /> carried. <br /> 10:19 a.m. executive session <br /> The board requested that Jack Zitterkopf and Chad Nabity stay for the executive session <br /> 11:04 a.m. Quandt made a motion and Richardson seconded to go out of executive session <br /> Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none <br /> voted no. Motion carried. <br /> 4b) Consideration of possible amendments to County zoning regulations for submission to <br /> Planning Commission pursuant to Article 10. Section 10.01 of Resolution 04-0020, specifically <br /> changes to definitional sections regarding adult establishments, regulations of adult <br /> establishments, opening of AG-SI and AG-SE zones to adult establishments as a permitted use <br /> with certain restrictions: presentation by County's legal counsel concerning case law and legal <br /> 3 <br />
