<br />q~r-~~~ ~ <br />as permittee, is the owner of a tract of land to-wit: The Northeast Quarter of the <br /> <br />.. <br /> <br />Northeast Quarter (NE1/4NE1/4) of Section Twenty-Three (23), Township Ten (10) <br />North, Range Twelve (12) West of the 6th P.M., Hall County; and <br /> <br />WHEREAS, permittee has applied for a permit to use the above described <br />property for operation of an anhydrous ammonia fertilizer facility and for petroleum <br /> <br />storage and accessory uses; and <br /> <br />WHEREAS, the above-described property is located in AG-l and AG-2 Zoning <br />Districts; and <br /> <br />WHEREAS, anhydrous ammonia fertilizer facilities and petroleum storage <br />facilities and accessory uses are permitted conditional uses in AG-1 and AG-2 Zoning <br /> <br />Districts; and <br /> <br />If I <br /> <br />._""............. <br /> <br />WHEREAS, the Hall County Board of Supervisors held a public hearing at its <br />regular meeting on August 4, 1992 at 10:00 a.m. on permittee's application following <br />published notice of said public hearing; and <br />WHEREAS, the County Board of Hall County, Nebraska has the authority <br />under the County Zoning Resolution to permit the use of real property for anhydrous <br />ammonia fertilizer facilities and similar toxic storage and accessory uses in AG-1 and <br />AG-2 Zoning Districts subject to such conditions as determined proper by the County <br />Board of Hall County, Nebraska. <br /> <br />NOW BE IT RESOLVED AS FOLLOWS: <br /> <br />1. That permittee's application for a conditional use permit to use the above- <br /> <br />described lands for an anhydrous ammonia. fertilizer facility and for petroleum <br />storage and accessory uses is hereby granted subject to the conditions, limitations, <br /> <br />and restrictions set forth herein. <br /> <br />II. That this conditional use permit with reference to the above-described <br /> <br />lands is approved and granted upon the following conditions: <br /> <br />1. That any accessory use of the premises shall be a use of a nature <br />customarily incidental and subordinate to the principal uses of an <br />anhydrous ammonia fertilizer facility and of a petroleum storage facility. <br /> <br />2. That all means of ingress and egress to the property shall be approved <br />by the county building inspector who shall consider automotive safety and <br />convenience, traffic flow and control, and access in case of fire or other <br />emergency. <br /> <br />3. That all structures, buildings, service drives, and parking and <br />storage areas shall be constructed and installed in accordance with the <br />county building codes and subject to the approval of the county building <br />inspector. <br /> <br />4. Off-street parking shall be provided at the rate of 1 space per 200 <br />square feet of gross floor area. <br /> <br />5. Areas used for the storage of anhydrous ammonia, petroleum products, <br />and similar toxic substance, and fertilizer application equipment shall be <br />enclosed within buildings or, if stored outdoor, shall be enclosed by chain- <br />link or other fence designed, constructed, and installed in such a manner <br />as to prevent the unauthorized entry of persons into said storage areas <br />during ~on-business hours. <br />. ~ <br />6. Storage and handling of anhydrous ammonia fertilizer, petroleum <br />products, and similar toxic substances shall comply with the general <br />industry standards for such activities or as required by local, state and <br />federal laws and regulatory agency rules and regulations.
