RESOLUTION# 15- 0 �ca A RESOLUTION DENYING A PERMIT FOR THE CONDITIONAL USE OF THE NORTHWEST QUARTER (NW 1/4) OF THE SOUTHWEST (SW 1/4) OF SECTION THRITY-FOUR (34), TOWNSHIP TEN (10) NORTH, RANGE NINE (9) WEST OF THE 6TH P.M., HALL COUNTY,NEBRASKA WHEREAS, Chad Ruda, d/b/a Mid America Washout, hereinafter referred to as "Applicant," has made application to the Board of Supervisors of Hall County, Nebraska, for a permit for the conditional use of a certain tract of real estate located within the zoning authority of the County of Hall, Nebraska, to-wit: the Northwest Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of Section Thirty-four (34), Township Ten (10) North, Range Nine (9) West of the 6th P.M., Hall County,Nebraska; and WHEREAS, Applicant has filed an application to use the above-described real estate, contingent upon the purchase of said real estate, for construction and operation of a livestock trailer washout; and WHEREAS, pursuant to Article 5 of the Hall County Zoning Resolution, the Board of Supervisors of Hall County, Nebraska, may authorize permitted conditional uses which are in conformance with the intent of the district in which it is proposed to be located upon consideration n Zoning Resolution; and of the factors set forth in Section 5.01 of the Hall County g , Y WHEREAS, the real estate is located in an A-3 Agriculture Zone in Hall County, Nebraska, and the requested use may be permitted as a conditional use pursuant to Hall County Zoning Resolution Section 4.04.03; and WHEREAS, the Hall County Board of Supervisors held a public hearing at its regular meeting on May 5, 2015, on the application of the Applicant following published notice of said public hearing; and WHEREAS, at said public hearing the public was given the opportunity to speak in favor of and in opposition to the application for conditional use; and WHEREAS,the Hall County Board of Supervisors finds that the requested conditional use will adversely affect the public interest, and that said Board is empowered under the Zoning Resolution to deny said conditional use. NOW, THEREFORE, BE IT RESOLVED, pursuant to the powers granted under the Zoning Resolution as adopted by the Board of Supervisors of Hall County, Nebraska, the Hall County Board of Supervisors does hereby deny to Chad Ruda, d/b/a Mid America Washout, a Conditional Use Permit to use the above-described real estate for the purpose of constructing and operating a livestock trailer washout for each and all of the following reasons: 1. The proposed livestock trailer washout would result in a substantial risk of air pollution, creating an unreasonable hazard or nuisance to adjacent landowners and the general public.
