RESOLUTION# 15- 0 a9 <br /> A RESOLUTION PERMITTING THE CONDITIONAL USE OF THE <br /> NORTHWEST QUARTER(NW 1/4) OF THE SOUTHWEST (SW 1/4) OF <br /> SECTION THRITY-FOUR(34), TOWNSHIP TEN (10) NORTH, RANGE NINE (9) <br /> WEST OF THE 6TH P.M.,HALL COUNTY,NEBRASKA <br /> WHEREAS, Chad Ruda, d/b/a Mid America Washout, hereinafter referred to as <br /> "Applicant," has made application to the Board of Supervisors of Hall County, Nebraska, for a <br /> permit for the conditional use of a certain tract of real estate located within the zoning authority of <br /> the County of Hall, Nebraska, to-wit: the Northwest Quarter (NW 1/4) of the Southwest Quarter <br /> (SW 1/4) of Section Thirty-four (34), Township Ten (10) North, Range Nine (9) West of the 6th <br /> P.M., Hall County,Nebraska; and <br /> WHEREAS, Applicant has filed an application to use the above-described real estate, <br /> contingent upon the purchase of said real estate, for construction and operation of a livestock <br /> trailer washout; and <br /> WHEREAS, pursuant to Article 5 of the Hall County Zoning Resolution, the Board of <br /> Supervisors of Hall County, Nebraska, may authorize permitted conditional uses which are in <br /> conformance with the intent of the district in which it is proposed to be located upon consideration <br /> of the factors set forth in Section 5.01 of the Hall County Zoning Resolution; and <br /> WHEREAS, the real estate is located in an A-3 Agriculture Zone in Hall County, <br /> Nebraska, and the requested use may be permitted as a conditional use pursuant to Hall County <br /> Zoning Resolution Section 4.04.03; and <br /> WHEREAS, the Hall County Board of Supervisors held a public hearing at its regular <br /> meeting on May 5, 2015, on the application of the Applicant following published notice of said <br /> public hearing; and <br /> WHEREAS, at said public hearing the public was given the opportunity to speak in favor <br /> of and in opposition to the application for conditional use; and <br /> WHEREAS, the Hall County Board of Supervisors finds that the requested conditional <br /> use, as limited herein, will not adversely affect the public interest, and that said Board is <br /> empowered under the Zoning Resolution to grant said conditional use. <br /> NOW, THEREFORE, BE IT RESOLVED, pursuant to the powers granted under the <br /> Zoning Resolution as adopted by the Board of Supervisors of Hall County, Nebraska, the Hall <br /> County Board of Supervisors does hereby grant to Chad Ruda, d/b/a Mid America Washout, a <br /> Conditional Use Permit to use the above-described real estate for the purpose of constructing and <br /> operating a livestock trailer washout, subject to the following conditions, restrictions and <br /> limitations: <br />
