21 DISCUSSION REGARDING OPEN MEETING LAW VIOLATION AND POTENTIAL <br /> VIOLATIONS — Lancaster expressed concern on the January 30 and February 5 facilities <br /> committee meetings and minutes regarding the cost of the transfer of the warranty of the Plaza <br /> Building roof and change orders for the courthouse project. There were 2 issues in the past <br /> when there were violations on a vote on a gravel pit and action was taken and referred it to the <br /> city. <br /> These should be recommendations form the committee. We need to be cautious how the <br /> county does business and questioned if there was paperwork that needed to be signed. <br /> Lanfear noted that isn't any paperwork on the warranty nothing has been done. He wanted to <br /> make sure the work could be done on the change orders and speed up the process. <br /> Arnold noted that if it is a purchasing issue the director should be able to process and the board <br /> could deny paying the bill. <br /> Mr. Zitterkopf stated that as an elected official he can buy a $500 or $1000 dollar item. Mr. <br /> Humphrey is appointed and the warranty could have consequences of$100,000.00 of dollars so <br /> this put him in a terrible position. He has the opinion that anything that comes to the committee <br /> should come to the board. They need to extend the warranty but need some consistency when <br /> items should come forward. The committee may not be the place to make these decisions. <br /> Arnold noted that this is just a transfer of the warranty and they are not obligating the county in <br /> the future. <br /> Mr. Zitterkopf stated that it is confusing when the committee meetings look like they are taking <br /> action for the parent board. <br /> Arnold questioned if they were inferring that something illegal had been done. <br /> Quandt expressed concern on the minutes and concern that the committees are making <br /> decision and not coming to the county board. <br /> The board will return to this discussion because there is a public hearing. <br /> 13.10:30 A.M. — PUBLIC HEARING FOR PUBLIC AMUSEMENT LICENSE FOR WOOD RIVER <br /> MUNICIPAL GOLF COURSE — Purdy made a motion and Lancaster seconded to open the <br /> public hearing for the amusement license. Arnold, Lancaster, Lanfear, Purdy, Quandt, <br /> Richardson and Schuppan all voted yes and none voted no. Motion carried. <br /> Chairman Arnold called for public participation. <br /> Travis Fairbanks representing the Wood River City council stated that the City of Wood River <br /> took ownership of the golf course to try and keep it open otherwise it would have been sold. <br /> Chairman Arnold called for any other questions. <br /> County Clerk Marla Conley explained that the Wood River County Club has renewed their <br /> amusement license but because it was an ownership change it was necessary to hold the public <br /> hearing and issue a new license. The licenses are now an annual renewal so they are in effect <br /> from January 1, 2015 to December 31, 2015. <br /> 5 <br />
