RESOLUTION if 15- 0 0(n <br /> A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR THE USE OF A <br /> TRACT OF LAND LOCATED IN THE SOUTH HALF OF THE SOUTHEAST <br /> QUARTER OF SECTION 33,TOWNSHIP 11 NORTH,RANGE 1I WEST OF THE <br /> 6TH P.M., HALL COUNTY, NEBRASKA <br /> WHEREAS,Mike Dobesh, hereinafter referred to as "applicant," is the owner of a parcel of real <br /> estate located at 11038 West Schimmer Road, Wood River,Nebraska, and described as the South <br /> Half of the Southeast Quarter of Section 33, Township 11 North, Ranch 11 West of the 6th P.M., <br /> Hall County,Nebraska,hereafter referred to as the"property"; and <br /> WHEREAS,applicant has made written application to use the property for the storage and retail <br /> sale of liquid fertilizer and herbicides, and for storage of tanks and equipment related to the <br /> described activities;and <br /> WHEREAS,the above-described property is located in a district presently zoned for AG-I <br /> Agricultural use; and <br /> WHEREAS, the proposed conditional use in a district zoned AG-1 is a permitted conditional use <br /> pursuant to section 5,paragraph 1.c. of the Zoning Resolution of T--Tall County,Nebraska,as <br /> amended; and <br /> WHEREAS, on February 24, 2015, a public hearing on said application was held by the Hall <br /> County Board of Supervisors upon due and proper notice of said hearing; and <br /> WHEREAS, at said public hearing the public was given the opportunity to speak in favor of and <br /> in opposition to the application for conditional use; and <br /> WHEREAS,the Hall County Board of Supervisors finds that such use is authorized under the <br /> conditional uses within the AG-1 District;that such use, as limited herein, will not adversely <br /> affect the public interest; and that said Board is empowered under the Zoning Resolution to <br /> permit such conditional use. <br /> NOW BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County,Nebraska, the <br /> Hall County Board of Supervisors hereby authorizes the conditional use of the above-described <br /> property for the storage and retail sale of liquid fertilizer and herbicides, and for storage of tanks <br /> and equipment related to the described activities subject to the following conditions: <br /> 1. The above-described real estate shall be used solely for the storage and retail sale of liquid <br /> fertilizer and herbicides, and for storage of tanks and equipment related to the described <br /> activities. The premises shall be maintained in a neat and clean condition at all times,free of <br /> debris and inflammable waste materials. All tanks used for liquid fertilizer storage shall have <br /> adequate containment features. Buildings used to warehouse herbicides shall be locked and <br /> • <br /> monitored by an appropriate security system. <br />
