RESOLUTION#14- C ri 7 <br /> A RESOLUTION TO RENEW A CONDITIONAL USE PERMIT FOR THE USE OF <br /> LOT ONE(I)IN WILHELM'SUBDIVISION,HALL COUNTY,NEBRASKA <br /> WHEREAS, Aurora Cooperative Elevator Company,hereinafter referred to as"applicant," is the <br /> lessee of the following described real estate,to-wit: <br /> Lot One(1)in Wilhelmi Subdivision,Hall County,Nebraska; and <br /> WHEREAS, applicant has made written application to use the above-described property for the <br /> storage in bulk of liquid propane and fertilizer and for storage of propane and fertilizer tanks and <br /> equipment related to the business operation of retail propane and fertilizer sales; and <br /> WHEREAS,the above-described property is located in a district presently zoned for AG-1 <br /> Agricultural use; and <br /> WHEREAS,the proposed conditional use in a district zoned AG-1 is a permitted conditional use <br /> pursuant to section 5,paragraph 1.c. of the Zoning Resolution of Hall County,Nebraska, as <br /> amended;and <br /> WHEREAS,on November 17,2014,a public hearing on said application was held by the Hall <br /> County Board of Supervisors upon due and proper notice of said hearing; and <br /> WHEREAS,.at said public hearing the public was given the opportunity to speak in favor of and <br /> in opposition to the application for conditional use; and <br /> WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under the <br /> conditional uses within the AG-1 District;that such use, as limited herein,will not adversely <br /> affect the public interest; and that said Board is empowered under the Zoning Resolution to <br /> permit such conditional use. <br /> NOW BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County,Nebraska,the <br /> Hall County Board of Supervisors hereby authorizes the conditional use of the above-described <br /> property for the storage in bulk of liquid propane and fertilizer and for storage of propane and <br /> fertilizer tanks and equipment related to the business operation of retail propane and fertilizer <br /> sales subject to the following conditions: <br /> 1. The above-described real estate shall be used solely for the storage in bulk of liquid propane <br /> 1 <br /> and fertilizer and for storage of propane and fertilizer tanks and equipment related to the business <br /> operation of retail propane and fertilizer sales. The real estate shall be enclosed by a wire mesh <br /> fence with suitable gates and locks thereon to prevent access by unauthorized persons. The <br /> premises shall be maintained in a neat and clean condition at all times, free of debris and <br /> inflammable waste materials. <br /> 2. Applicant shall comply with the Hall County Zoning Resolution with respect to the use of the <br /> above-described property. <br />
