notice to the Applicant or operator to determine compliance with county resolutions and <br /> codes and to prevent structural and equipment failures and accidents which may cause <br /> damage, injuries or nuisances to the public. Inspections may be made to determine <br /> compliance with the Hall County Zoning Resolution, federal and state law or regulations, <br /> or applicable ANSI standards. <br /> 13. Abandonment. If the tower shall cease to be used for a period of three hundred <br /> sixty-five (365) consecutive days, the Zoning Department shall notify the Applicant that <br /> the site will be subject to a determination by the Zoning Department Director that the site <br /> has been abandoned. Upon issuance of a Notice to Show Cause by the Zoning <br /> pp <br /> Department Director, the Applicant shall have thirty (30) days to show by a <br /> P <br /> preponderance of the evidence that the tower has been in use or under repair during the <br /> period of apparent abandonment. In the event the Applicant fails to show that the tower <br /> has been in use or under repair during the relevant period, the Zoning Director shall issue <br /> a final determination of abandonment of the site and the Applicant shall have seventy five <br /> (75) days thereafter to dismantle and move the tower. <br /> 14. Term. The term of the permit shall be for a period of five (5) years from August <br /> 18, 2014 unless terminated pursuant to paragraph 5. This permit shall run with the land <br /> during the permit=s duration and may be transferred, conveyed and assigned by the <br /> applicant to assigns and successors-in-interest. <br /> 15. Termination of Permit. The County of Hall, Nebraska may terminate this permit <br /> in the event that Applicant fails to comply with any of the conditions, restrictions and <br /> obligations set forth herein.
