RESOLUTION #14- O I _ <br /> A RESOLUTION GRANTING A CONDITIONAL USE PERMIT <br /> FOR THE USE OF A TRACT OF LAND BEING PART OF THE <br /> NORTHEAST QUARTER OF THE NORTHEAST QUARTER(NE 1/4 NE 1/4) <br /> OF SECTION THIRTY-ONE (31),TOWNSHIP TEN (10)NORTH, <br /> RANGE ELEVEN (11)WEST OF THE SIXTH PRINCIPAL MERIDIAN, <br /> HALL COUNTY,NEBRASKA; <br /> APPLICATION OF NE COLORADO CELLULAR,INC., DBA VIAERO WIRELESS <br /> WHEREAS, NE Colorado Cellular, Inc., dba Viaero Wireless, hereinafter referred to as <br /> the AApplicant,@ has made an application for renewal of a Conditional Use Permit pursuant to <br /> the Hall County Zoning Resolution for the conditional use of the following described property <br /> for the erection, operation and maintenance of a 195 foot self-supporting communications tower <br /> and an associated equipment shelter all upon the following described property, to-wit: <br /> A tract of land being part of the Northeast Quarter of the Northeast Quarter (NE <br /> 1/4 NE 1/4) of Section Thirty-one (31), Township Ten (10) North, Range Eleven <br /> (11) West of the Sixth Principal Meridian, Hall County, Nebraska, more <br /> particularly described as follows: Referring to the Northeast corner of said Section <br /> 31 and assuming the North line of said Northeast Quarter as bearing S 89°59'24" <br /> W and all bearings contained herein are relative thereto; thence S 89°59'24" on <br /> said North line a distance of 45.0 feet to the ACTUAL PLACE OF BEGINNING, <br /> said place of beginning being on the West right-of-way line of Nebraska State <br /> Highway No. 11; thence S 00°33'32 W on said West right-of-way line a distance <br /> of 438.0 feet; thence S 89°59'43" W a distance of 464.95 feet to the Southeast <br /> corner of a tract of land as described in Book 178 of Deeds, page 17 and recorded <br /> in the Hall County Register of Deeds; thence N 00°10'30" E on the East line of <br /> said tract a distance of 302.79 feet to the Northeast corner of said tract and being <br /> on the North line of said Northeast Quarter; thence N 89°5924" E on said North <br /> line a distance of 917.89 feet to the place of beginning, containing 7.319 acres <br /> more or less, of which 0.661 acres, more or less, are presently being used for road <br /> purposes on the north side; and <br /> WHEREAS, a public hearing regarding said application was held by the County Board of <br /> Supervisors of Hall County, Nebraska on October 21, 2014 after due and proper notice of same <br /> being afforded the public; and <br /> WHEREAS, the said property is located within the AG-1 Agricultural Zoning District; <br /> and <br />
