Motion <br /> carried. <br /> 7B) ACTION ON THE APPLICATION OF BOSSELMAN ENERGY, INC. APPLICATION FOR A <br /> CONDITIONAL USE PERMIT—Quandt made a motion and Lancaster seconded to approve <br /> Resolution#14-038 for the condition use permit for Bosselman Energy. Arnold, Lancaster, <br /> McFarland, Purdy, Quandt, Schuppan and Ziola all voted yes and none voted no. Motion <br /> carried. <br /> RESOLUTION#14 c) 3 <br /> A RESOLUTION AUTHORIZING THE CONDITINAL USE OF LOT TWO(2), <br /> BUDD SECOND SUBDIVISION,HALL COUNTY,NEBRASKA <br /> WHEREAS, Bosselman Energy Inc. made application to the Hall County Building-Zoning <br /> Administrator for the renewal of a permit for the conditional use of a certain tract of real estate located within <br /> the zoning authority of the County of Hall, to-wit: Southeast Quarter of the Northeast Quarter(SE 1/4 NE <br /> 1/4) of Section One (1), Township Ten (10)North, Range Twelve(12) West of the 6th PM in Hall County, <br /> Nebraska,also known as Lot Two(2),Budd Second Subdivision. <br /> WHEREAS,pursuant to Section 11 of the Hall County Zoning Resolution,the Hall County Board of <br /> Supervisors may authorize permitted conditional uses which are in conformance with the intent of the district <br /> in which it is proposed to be located upon consideration of the factors set forth in Section 11(d)of the Zoning <br /> Resolution;and <br /> WHEREAS, on August 12, 2014, the Hall County Board of Supervisors held a public hearing on <br /> said application following due and proper publication of notice. <br /> THEREFORE, BE IT RESOLVED that the application for a conditional use of the above-described <br /> real estate for operation of a wholesale propane gas distribution facility be hereby approved subject to the <br /> following conditions,limitations and requirements: <br /> 1. The facility shall be developed in accordance with the site plan dated April 14, 1999, as <br /> approved by the Regional Planning Director and the County Building Inspector. <br /> 2. The facility shall comply with applicable state and federal licensing regulations concerning <br /> storage,transportation and sales of propane gas. <br /> 3. Bulk propane tank areas shall be fenced with a chain link security fence of not less than eight(8) <br /> feet in height. <br /> 4. There shall be no dealer sales or individual sales on site. <br /> 5. Entrance to the facility shall be through the northerly drive and exit from the facility shall be <br /> through the southerly drive. <br /> 6. This conditional use permit approval shall be valid for a five year period from and after August <br /> 18,2014,subject thereafter to application for renewal. <br />
