RESOLUTION NO. 14-Q <br /> A RESOLUTION APPROVING CONSERVATION EASEMENT FOR THE NATURE CONSERVANCY. <br /> WHEREAS,The Nature Conservancy,a District of Columbia non-profit corporation having a local address <br /> of 1007 Leavenworth St.,Omaha,NE 68102,are the owners of the following described real estate,to-wit: <br /> All of Lots One(1),Two(2),Three(3),and Four(4)Island in Section Twenty-Eight(28),Township Nine <br /> (9)North,Range Twelve(12)West of the 6th P.M.,Hall County,Nebraska,together with all accretions thereto, <br /> excepting a certain tract more particularly described in Deed Book 64,Page 205,and excepting a certain tract more <br /> particularly described Return of Appraisers in Book 9,Page 659. <br /> And also except the following: <br /> A tract of land comprising a part of Government Lot 4, in Section 28,Township 9 North,Range <br /> 12 West of the 6t'P.M.,said tract being more particularly describes as follows: <br /> With a reference to the Northwest Corner of said Section 28: thence running S 00 degrees 14'00" <br /> E on the West line of said Lot 4 for a distance of 1,376.00 feet to a point on the Southerly right-of- <br /> way line of Interstate Highway#80,said point being the actual POINT OF BEGINNING;thence <br /> continuing S 00 degrees 14' 00"E for 44.00 feet to a point on the high bank of the Platte River; <br /> thence N 71 degrees 49' 34"E on said high bank of the Platte River for 42.06 feet;thence N 27 <br /> degrees 49'48"W fir 39.54 feet to a point on said Southerly right-of-way line of Interstate <br /> Highway#80;thence S 77 degrees 59' 00"W on said right-of-way line for 22.00 feet to the <br /> POINT OF BEGINNING. <br /> and <br /> WHEREAS,The Nature Conservancy is desirous of retaining a conservation easement on said property; <br /> and <br /> WHEREAS,The Nature Conservancy has submitted a request to Hall County for the approval of a <br /> conservation easement on the real estate legally described hereinabove;and <br /> WHEREAS,pursuant to NEB.REV.STAT. §76-2, 112(2003),on April 8,2014,the Hall County Board of <br /> Supervisors forwarded the easement request to the Hall County Joint Planning Commission for their review and <br /> recommendations regarding the conformity of the proposed acquisition to comprehensive planning for the area;and <br /> WHEREAS,also pursuant to NEB.REV. STAT. §76-2, 112(2003),on May 7,2014 the Hall County Joint <br /> Planning Commission recommended approval of the easement at their regularly scheduled meeting; <br /> NOW,THEREFORE, BE IT RESOLVED by the Hall County Board of Supervisors that the designated <br /> conservation easement on the real estate legally described hereinabove and as more substantially set forth in the <br /> Deed of Conservation Easement attached hereto as Exhibit"A"and incorporated herein by this reference,should be, <br /> and hereby is,approved. <br />
