Lancaster made a motion and Arnold seconded to approve the engagement letter and authorize <br /> the chair to sign. Arnold, Lancaster, McFarland, Purdy, Quandt, Schuppan and Ziola all voted <br /> yes and none voted no. Motion carried. <br /> 12. DISCUSS AND AUTHORIZE CHAIR TO SIGN CONTRACT WITH DIAMOND DRUGS INC. <br /> Mr. Ruiz was present this contract will replace the contract with U Save Pharmacy their contract <br /> will expire March 30th. This was the only response to the RFP that the county received and it <br /> was put out for bids twice. Mr. Ruiz stated that Douglas and Lancaster County use Diamond <br /> and with the savings they have been able to staff more positions. The county should see some <br /> savings. <br /> Mr. Ziola stated this went to the corrections steering committee and they recommended <br /> approving the contract. <br /> Ziola made a motion and Lancaster seconded to approve the contract with Diamond Pharmacy. <br /> This company was able to meet the requirements to tract meds with the current health care <br /> provider. Arnold, Lancaster, McFarland, Purdy, Schuppan and Ziola all voted yes and Quandt <br /> voted no. Motion carried. <br /> 4. COUNTY ATTORNEY -A) EXECUTIVE SESSION — DISCUSSION OF PENDING <br /> LITIGATION— Lancaster made a motion and Arnold seconded to go into executive session <br /> regarding pending litigation. This executive session is to protect the public interest. Arnold, <br /> Lancaster, McFarland, Purdy, Quandt, Schuppan and Ziola all voted yes and none voted no. <br /> Motion carried. <br /> 10:15 a.m. executive session <br /> 10:30 a.m. Quandt made a motion and Lancaster seconded to go out of executive session. <br /> Arnold, Lancaster, McFarland, Purdy, Quandt, Schuppan and Ziola all voted yes and none <br /> voted no. Motion carried. <br /> Mr. Zitterkopf stated that claim number 13040192 was denied by the county board April 23, <br /> 2013 and it was appealed in District Court. The court ordered that the claim should be paid and <br /> the county would also be responsible to pay the court costs. <br /> B) DISCUSSION AND ACTION ON PAYMENT OF JERRY FOGARTY CLAIM #13040192 AND <br /> ASSOCIATED COURT COSTS —Ziola made a motion and Lancaster seconded to approve the <br /> claim to Jerry Fogarty in the amount of$1,932.00 and the claim for the court costs to District <br /> Court in the amount of$82.00. Lancaster stated that the board did not have an issue to pay the <br /> claim it was because the claim was 2 years old. Arnold, Lancaster, McFarland, Purdy, Quandt, <br /> Schuppan and Ziola all voted yes and none voted no. Motion carried. <br /> Mr. Zitterkopf requested that the check for Mr. Fogarty be sent to him because he has a letter of <br /> release. The court costs will need to be sent to District Court. <br /> 4 C)DISCUSSION AND ACTION TO RETAIN JERRY PIGSLEY TO REPRESENT THE <br /> COUNTY AND VARIOUS OF ITS DEPARTMENTS BEFORE THE COURT OF INDUSTRIAL <br /> RELATIONS IN ACTION FILED BY THE FRATERNAL ORDER OF POLICE— Mr. Zitterkopf <br /> stated that the Court of Industrial Relations has sent subpoenas to the County Clerk and several <br /> others. This matter needed immediate attention and Mr. Young and Mr. Zitterkopf made an <br /> executive decision and hired Mr. Jerry Pigsley for this case. He has already filed responses <br /> 4 <br />
