<br />/9,(/- /3 <br /> <br />" , <br />~ HALL COUNTY BOARD OF SUPERVISORS MEETING, JANUARY 21, 1992 <br /> <br />t?~he Hall County Board of Supervisors met at 9:00 A.M. from adjourned session <br />and by published call with Chairman Margaret Landis presiding. <br /> <br />Present on roll call were Irene Abernethy, Richard Frauen, Richard Hartman, <br />Margaret Landis, Robert Leslie, Gary Quandt and Bill Wright. None were absent. <br /> <br />Invocation was given by Abernethy. <br /> <br />Pledge of Allegiance was given. <br /> <br />Minutes of January 14th meeting were approved as received by mail, on motion <br />by Quandt, seconded by Frauen. On roll call vote" Abernethy, Frauen, Hartman, <br />Landis, Leslie, Quandt and Wright voted yes, none voted no. Motion "carried. <br /> <br />Deputy County Attorney Jerry Janulewicz was present. He gave update report <br />on odor problem in Administration building. The remaining soil samples have <br />been tested, all negative or same results as before." Next step will be to <br />consider air samples in the building at estimated cost of up to $3500.00, <br />will probably take 2 days. State hygienist will do extensive search and <br />will make report to county board members and county employees. <br />Motion by Hartman, seconded by Quandt to hire state hygienist and have <br />the tests made as soon as possible. On roll call vote Abernethy, Frauen, <br />Hartman, Leslie, Quandt, Wright and Landis voted yes, none voted no. Motion <br />carried. <br /> <br />Janulewicz spoke in regard to the American Disabilities Act. <br />Board needs to appoint a person to accept any complaints and <br />grievance procedure. He has prepared a resolution, which he <br />recommended the Board appoint Ellen Merrill, Board Assistant <br />contact person. <br />Motion by Abernethy, seconded by Quandt to adopt Resolution #1341 as' <br />presented and approve the appointment of Ellen Merrill as contact person. <br />On roll call vote Abernethy, Frauen, Hartman, Leslie, Quandt, Wright and <br />Landis voted yes, none voted no. Motion carried. <br /> <br />The County <br />adopt a <br />read, and <br />to be the <br /> <br />RESOLUTION # /3'11 <br /> <br />ADA GRIEVANCE PROCEDURE <br /> <br />BE IT HEREBY RESOLVED AS FOLLOWS: <br /> <br />The County of Hall, Nebraska, has adopted an internal grievance <br /> <br />procedure providing for prompt and equitable resQlution of complaints <br />alleging any action prohibited by the U.S. Department of Justice <br /> <br />regulations implementing title II of the Americans with Disabilities Act. <br /> <br />Title II states, in part, that "no otherwise qualified disabled individual <br /> <br />shall, solely by reason of such disability, be excluded from the <br /> <br />participation in, be denied the benefits of, or be subjected to <br /> <br />discrimination" in programs or activities sponsored by a public entity. <br /> <br />Complaints should be addressed to: <br /> <br />Ellen Merrill, <br /> <br />County <br /> <br />Administration Assistant, 121 S. Pine Street, Grand Island, Nebraska 68801 <br /> <br />(308) 381-5093, who has been designated to coordinate ADA compliance <br /> <br />efforts. <br /> <br />1. A complaint should be filed in writing or verbally, contain the <br />name and address of the person filing it, and briefly describe the alleged <br />violation of the regulations. <br /> <br />2. A complaint should be filed within twenty (20) days after the <br />complainant becomes aware of the alleged violation. (Processing of <br />allegations of discrimination which occured before this grievance procedure <br />was in place will be considered on a case-by-case basis.) <br /> <br />) <br />3. An investigation, as may be appropriate, shall follow a filing of <br />complaint. The investigation shall be conducted by Ellen Merrill. These <br />rules contemplate informal but thorough investigations, affording all <br />interested persons and their representatives, if any, an opportunity to <br />
