93;:",;? 17' /') o Doris Mason, Hall County Treasurer was present requesting payment of health ~ insurance increase for her employees since they had voted to withdraw from the CWA as of June 16, 1993. Deputy Attorney Janulewicz spoke breifly and requested an Executive ~ Session for advice to County Board members by legal counsel. Motion by Landis, seconded by Stelk to recess for Executive Session to receive advise from legal counsel on health insurance request. Abernethy, Frauen, Hartman, Landis, Leslie, Quandt and Stelk voted yes, none voted no. Motion carried. Executive Session at 9:24 a.m. and returned to regular session at 9:40 a.m .on motion by Landis, seconded by Frauen. Abernethy, Frauen, Hartman, Landis, Leslie, Quandt and Stelk voted yes, none voted no. Motion carried. Chairman Quandt asked if County Board members wished to take any action on the County Treasurer's request for payment of health insurance increases. No motion was made. Deputy Attorney Janulewicz made statement in regard to the legal binding contract with Communication Workers of America. liThe request was for the County Board to approve the increase in health insurance benefits for the employees of the Treasurer's office to that which will be received by non- bargaining unit members for the upcoming fiscal year. At this point we have a legal binding agreement with the Communication Workers of America and the County that governs what benefits and what compensations we provide to the employees of the Treasurer's office, irrespective of whether the employees of that office now want to be bound by that agreement or not. Legally the County is bound by that agreement with CWA. If the county would take some other action by then giving the employees more benefits or less benefits than that provided for in our agreement, if the County should be sued by the Communication Workers of America - - a breech of contract or unfair labor practice action, would raise potential liability for the County and possible litigation. Therefore my recommendation to the Board would be that there be no change in the benefits from that which are provided for in our agree- ment between CWA and Hall County and that office, until the termination date of that contract which is June 30, 1994. Motion by Frauen, seconded by Abernethy to recess for Executive Session for discussion of FOP negotiations. Abernethy, Frauen, Hartman, Landis, Leslie, Quandt and Stelk voted yes, none voted no. Motion carried. Executive Session at 9:51 a.m. and returned to regular session at 10:19 a.m. on motion by Frauen, seconded by Abernethy.
