<br />93;:",;? 17' <br /> <br />/') <br />o <br /> <br />Doris Mason, Hall County Treasurer was present requesting payment of health <br />~ insurance increase for her employees since they had voted to withdraw from <br />the CWA as of June 16, 1993. <br />Deputy Attorney Janulewicz spoke breifly and requested an Executive <br />~ Session for advice to County Board members by legal counsel. <br />Motion by Landis, seconded by Stelk to recess for Executive Session to <br />receive advise from legal counsel on health insurance request. Abernethy, <br />Frauen, Hartman, Landis, Leslie, Quandt and Stelk voted yes, none voted no. <br />Motion carried. <br /> <br />Executive Session at 9:24 a.m. and returned to regular session at 9:40 a.m <br />.on motion by Landis, seconded by Frauen. Abernethy, Frauen, Hartman, Landis, <br />Leslie, Quandt and Stelk voted yes, none voted no. Motion carried. <br /> <br />Chairman Quandt asked if County Board members wished to take any action on <br />the County Treasurer's request for payment of health insurance increases. <br />No motion was made. <br /> <br />Deputy Attorney Janulewicz made statement in regard to the legal binding <br />contract with Communication Workers of America. liThe request was for the <br />County Board to approve the increase in health insurance benefits for the <br />employees of the Treasurer's office to that which will be received by non- <br />bargaining unit members for the upcoming fiscal year. At this point we have <br />a legal binding agreement with the Communication Workers of America and the <br />County that governs what benefits and what compensations we provide to the <br />employees of the Treasurer's office, irrespective of whether the employees <br />of that office now want to be bound by that agreement or not. Legally the <br />County is bound by that agreement with CWA. If the county would take some <br />other action by then giving the employees more benefits or less benefits <br />than that provided for in our agreement, if the County should be sued by the <br />Communication Workers of America - - a breech of contract or unfair labor <br />practice action, would raise potential liability for the County and possible <br />litigation. Therefore my recommendation to the Board would be that there <br />be no change in the benefits from that which are provided for in our agree- <br />ment between CWA and Hall County and that office, until the termination date <br />of that contract which is June 30, 1994. <br /> <br />Motion by Frauen, seconded by Abernethy to recess for Executive Session for <br />discussion of FOP negotiations. Abernethy, Frauen, Hartman, Landis, Leslie, <br />Quandt and Stelk voted yes, none voted no. Motion carried. <br /> <br />Executive Session at 9:51 a.m. and returned to regular session at 10:19 a.m. <br />on motion by Frauen, seconded by Abernethy. Abernethy, Frauen, Hartman, <br />Landis, Leslie, Quandt and Stelk voted yes, none voted no.
