<br />APRIL 20, 1993

<br />~. The Hall County Board of Supervisors met at 9:00 a.m. from adjourned session
<br />and by published call with Chairman Gary Quandt presiding.
<br />
<br />Present on roll call were Irene Abernethy, Richard Frauen, Richard Hartman,
<br />Margaret Landis, Robert Leslie, Gary Quandt and Tammie Stelk. None were
<br />absent.
<br />
<br />Invocation was given by Abernethy.
<br />
<br />Pledge of Allegiance was given.
<br />
<br />Minutes of April 13th meeting were approved as received, on motion by Frauen,
<br />seconded by Stelk. Abernethy, Frauen, Hartman, Landis, Leslie, Quandt and
<br />Stelk voted yes, none voted no. Motion carried.
<br />
<br />Deputy County Attorney Jerome Janulewicz and Deputy Attorney Mark Young were
<br />present.
<br />
<br />Attorney Janulewicz requested an Executive Session for litigation strategy
<br />on two cases for Carpenter Cars Vs Board of Equalization 1991-1992 property
<br />tax years and Roesler vs Region III Mental Retardation Services.
<br />Motion by Stelk, seconded by Frauen to recess for Executive Session as
<br />requested by attorneys. Abernethy, Frauen, Hartman, Landis, Leslie, Quandt,
<br />and Stelk voted yes, none voted no. Motion carried. '

<br />Executive Session at 9:07 a.m. and returned to regular session at 9:29 a.m.
<br />on motion by Landis, seconded by Frauen. Abernethy, Frauen, Hartman, Landis,
<br />Leslie, Quandt and Stelk voted yes, none voted no. Motion carried.
<br />
<br />Attorney Janulewicz recommended approve offer to confess judgement in court
<br />case #104-130 in amount of $347,667.00 and Case #108-054 in amount of
<br />$357,765.00 as discussed in executive session.
<br />Motion by Landis, seconded by Frauen to approve Deputy County Attorney
<br />recommendation to confess judgement and authorize chairman to sign the Warrant
<br />of Attorney and offer to confess. Abernethy, Frauen, Hartman, Landis,Leslie,
<br />Quandt and Stelk voted yes, none voted no. Motion carried.
<br />
<br />Attorney Young recommends authorizing Roger Cox, Attorney for firm of Harding
<br />& Ogborn to enter into settlement agreement in case of Roesler vs Regional
<br />Governing Board of Region III Mental Retardation Services as discussed in
<br />executive session and adopt resolution presented.
<br />Motion by Landis, seconded by Abernethy to approve recommendation of
<br />attorney and adopt Resolution #1484 as presented. Abernethy, Frauen,
<br />Hartman, Landis, Leslie, Quandt and Stelk voted yes, none voted no. Motion
<br />carried.

<br />.
<br />
<br />WHEREAS, Hall County has been sued in the case of Roesler v.
<br />Regional Governing Board of Region III Mental Retardation Services
<br />
<br />et. al.; and
<br />WHEREAS, Hall County is represented by the firm of Harding &
<br />
<br />Ogborn in said case; and
<br />WHEREAS, the plaintiff and defendants have reached an
<br />agreement in said case to settle the case without direct cost to
<br />
<br />the county.
<br />BE IT RESOLVED that Mr. Roger Cox of the firm of Harding &
<br />Ogborn is authorized by the Board of Supervisors of Hall County,
<br />Nebraska, to enter into a settlement agreement with the defendants
<br />in the above case wherein that Region III will pay all sums due the
<br />plaintiff pursuant to said settlement agreements.
