<br />:e, <br /> <br />r:3r- 77 <br /> <br />(1), Wild Rose Ranch Estates Subdivision, Hall County, Nebraska, a survey of <br /> <br /> <br />which is attached hereto and incorporated herein by the reference; and <br /> <br /> <br />WHEREAS owner has made a written application to use the above-described <br /> <br />r- <br /> <br />property for the erection and operation of a portable asphalt mixing plant to be <br /> <br />used for the manufacture of paving material for county road overlay project <br /> <br />STP2080 (1) Wood River Southwest and State of Nebraska project RS-L40C (1001) <br /> <br />Alda South; and <br />WHEREAS a public hearing on said application was held on March 2 1993, <br /> <br />by the Hall County Board of Supervisors following due and proper notice; and <br /> <br />WHEREAS the Hall County Zoning Resolution permits the authorization of a <br /> <br />non conforming conditional use for a period not exceed two years. <br /> <br />NOW BE IT RESOLVED that the application of owner for a temporary <br /> <br />conditional use of the above-described property is hereby granted subject to the <br /> <br />following conditions, <br /> <br />1. That owner may erect and operate a portable asphalt mlXlng plant <br />upon said property, said plant to be used for the manufacture of <br />road paving material for the above-described projects. <br /> <br />2. This resolution of temporary conditional use shall be valid upon <br />adoption by majority vote of the members of the Hall County Board <br />of Supervisors and shall terminate upon completion of County Road <br />Project STP2080 (1) Wood River Southwest and State of Nebraska <br />Project RS-L40C (1001) Alda South or two years, whichever is <br />earlier. . <br /> <br />3. Rubbish, trash, and debris shall not be stored or allowed to <br />accumulate upon the premise. <br /> <br />4. Equipment, rolling stock and vehicles shall not be stored or par ked <br />within 60 feet of public road right of ways adjacent to the premises. <br /> <br />5. Owner shall comply with any and all applicable State and Federal <br />laws, administrative rules, and regulations pertaining to air and <br />water quality; owner shall not use the property in such a manner as <br />to result in a nuisance to adjoining landowners or the general <br />public. <br /> <br />6. Owner shall comply with the Hall County Zoning Resolution and <br />County Building Codes with respect to the use of the above- <br />described property. <br /> <br />7. Throughout the term of this permit and upon its completion the <br />owner shall maintain all county roads used for haul roads by owner, <br />its subcontractors, vendors and vendees in transporting equipment <br />and materials from the above-described property to the locations of <br />the above-named road projects. Such maintenance shall include, but <br />shall not be limited to, the maintenance and repair of asphalt road <br />surfaces and grading, graveling and controlling dust on non-paved <br />road surfaces. <br /> <br />8. This permit may be terminated for any act or acts of noncompliance <br />with the terms and conditions of this resolution. The Hall County <br />Board of Supervisors shall provide written notice to owners of any <br />act or acts constituting noncompliance. Owner shall have 14 days to <br />cure such non-compliance. In the event owner fails to cure such <br />non-compliance the County Board may terminate or revoke this <br />permit. <br /> <br />9. Nothing in this resolution shall be construed as a grant of right, <br />authority or privilege to permit or allow any use of land, equipment, <br />materials or methods which violates any State or Federal law or any <br />rule or regulation of any State of Federal administrative agency. <br /> <br />10. The acceptance by owner of any benefits or right pursuant to this <br />resolution shall constitute owner's agreement to be bound by terms, <br />conditions and restrictions of this resolution. <br />
