No uses' permitted pursuant to this resolution shall <br />result in unreasonable air pollution or pollution of surface <br />or groundwater so as to create an unreasonable hazard or <br />nuisance to the adjacent land owners or the general public. <br /> <br />4. Water accumulated on the premises as a result. of the <br />mining and pumping of sand and gravel shall be retained upon <br />the premises and shall not be permitted to flow upon or <br />encroach upon adj acent lands. Any drains and drainage <br />ditches located upon the premises shall be maintained and <br />kept open by permitee, <br /> <br />5. permitee shall not permit the hauling of sand and gravel <br />from the premises and over or across any public roads or <br />highways unless said sand and gravel is completely dry' and <br />free of water or unless said sand and gravel is hauled in <br />trucks constructed or equipped so as to prevent water from <br />flowing from said trucks onto the traveled portion of the <br />public roads and highways. <br /> <br />6 . Weight restrictions on county bridges to the West and <br />North of the above-described real estate shall be complied <br />with by permitee when hauling sand or gravel mined, pumped, <br />stored upon, or hauled from the above-described real estate. <br /> <br />The term of the Conditional Use permitted by this resolution <br />shall be for a period of five (5) years from the date <br />hereof, but may be terminated, revoked and cancelled if the <br />permitee fails to comply with any of the conditions, <br />restrictions, and limitations set forth' herein. In the <br />event. of any such event of noncompliance, the Hall CoUnty <br />Board of Supervisors shall notify the permitee in' writing <br />setting forth the specific event or event of noncompliance. <br />If the permitee fails to take reasonable action to comply <br />with the notice of noncompliance and correct any or all <br />violations within 30 days after' receiving said notice, the <br />Hall County Board of Supervisors shall hold a hearing' to <br />consider the revocation, termination, or cancellation of <br />said permitted conditional uses. <br /> <br />Nothing in this grant of conditional use shall be construed <br />as a grant of right, authority or permit to allow any use of <br />land~ materials or methods which violate any state or <br />federal law or rule or regulation of a federal, state or <br />local agency.
