<br />The Hall County Board of Supervisors met at 9:00 a.m. from adjourned session
<br />and by published call with Chairman Richard Hartman presiding.
<br />
<br />Present on roll call were Irene Abernethy, Richard Hartman, Margaret Landis,
<br />Robert Leslie, Gary Quandt and Tammie Stelk. Absent was Richard Frauen.
<br />
<br />Invocation was given by Robert Leslie.
<br />
<br />Pledge of Allegiance was given.
<br />
<br />Minutes of March 22nd meeting were accepted as received on motion by Quandt,
<br />seconded by Stelk. Abernethy, Hartman, Landis, Leslie, Quandt and Stelk
<br />voted yes, none voted no, with Frauen absent. Motion carried.
<br />
<br />Deputy County Attorney JeromJanulewicz was present. He presented resolution
<br />for Conditonal Use Permit for Hooker Brothers Inc.
<br />Motion by Leslie, seconded by Abernethy to adopt Resolution #1555 as
<br />'presented. Abernethy, Hartman, Leslie, Quandt and Stelkvoted yes, none
<br />voted no, Landis abstained, due to conflict of interest and Frauen absent.

<br />
<br />A RESOLUTION PERMITTING THE CONDITIONAL USE OF THE WEST HALF
<br />(W1/2) OF THE NORTHEAST QUARTER (NE1/4) OF SECTION NINE (9),
<br />TOWNSHIP ELEVEN (11) NORTH, RANGE TEN (10) WEST OF THE 6th
<br />P . M., HALL COUNTY, NEBRASKA
<br />
<br />WHEREAS, William J. Landis is the owner of the following
<br />described real estate, to wit:
<br />
<br />The .West Half (W1/2) of the Northeast Quarter (NE1/4) of
<br />Section Nine (9), Township Eleven (1.1.) North, Range Ten (1.0)
<br />West of the 6th P.M., Hall County, Nebraska; and .
<br />
<br />WHEREAS, the above-described real estate is located in an
<br />area in Hall County, Nebraska, presently zoned for
<br />agricultural use (AG-2); and
<br />
<br />WHEREAS, Hooker Brothers, Inc., a Nebraska Corporation, has
<br />entered into an agreement with William J. Landis under which
<br />Hooker Brothers, Inc., is authorized to mine and pump sand
<br />and gravel from the above described real estate; and
<br />
<br />WHEREAS, Hooker Brothers, Inc., hereinafter referred to as
<br />"permitee," has presented an application to use the above-
<br />described real estate for the mining and pumping of sand and
<br />gravel and accessory uses; and
<br />
<br />WHEREAS, the Hall County Board of Supervisors finds that the
<br />requested conditional use is authorized under the
<br />conditional uses set forth in the permitted conditional uses
<br />in an AG-2 zoning district and further finds that said use,
<br />under appropriate conditions, restrictions, and limitations;
<br />will not adversely effect the public interest and that the
<br />County Board of Supervisors. in empowered with authority
<br />under the County Zoning Resolution to grant said Conditional
<br />Use.

<br />NOW, THEREFORE, pursuant. to the powers granted under the
<br />Zoning Resolution as adopted by the Board of Supervisors of
<br />Hall County, Nebraska, the Hall County board of Supervisors
<br />hereby approves of the application of permitee for the
<br />conditional use of the above-described real estate for the
<br />purpose of mining and pumping sand and gravel therefrom and
<br />for accessory uses for a period of five (5) years from the
<br />granting hereof, SUBJECT TO the following conditions,
<br />restrictions, and limitations which are made a part hereof
<br />and are set out hereafter:
<br />
<br />1.. All rubbish and debris must be completely cleared from
<br />the above-described real estate as soon as practical and
<br />said real estate must, at all times, be kept in a clean and
<br />neat .condition.

<br />lumber, bricks, refuse or junk material of any nature
<br />whatsoever ~y be dumped, placed or located in the proposed
