<br />HALL COUNTY BOARD OF SUPERVISORS MEETING, AUGUST 8, 1995

<br />The Hall County Board of Supervisors met at 9:00 A.M. from adjourned session
<br />and by published call with Chairman Irene Abernethy presiding.
<br />
<br />Present on roll call were Irene Abernethy, Richard Hartman, Margaret Landis,
<br />Robert Leslie, Gary Quandt, Judy Rosenkotter and Tammie Stelk. None were
<br />absent.
<br />
<br />Invocation was given by Rev Richard Urbach, Faith United Methodist Church.
<br />
<br />Pledge of Allegiance was given.
<br />
<br />Motion by Quandt, seconded by Hartman to accept minutes of August 1st
<br />meeting as received, after corrections were made. Abernethy, Hartman,
<br />Landis, Leslie, Quandt, Rosenkotter and Stelk voted yes, none voted no.
<br />Motion carried.
<br />
<br />News media questioned if meeting was being tape recorded today. Discussion
<br />followed, Determined was not required. On show of hands as to use of the
<br />recorder, Abernethy, Rosenkotter and Stelk thougbt should. Four did not
<br />think needed to use recorder.
<br />
<br />Quandt questioned the minutes of committee meetings being made available to
<br />news media. Discussion followed and determined when committee meetings are
<br />presented at a County Board meeting they become public record.and copies
<br />coulddbemade available then.
<br />Motion by Quandt, seconded by Stelk to have Committee meeting minutes
<br />accepted when voted on regular weekly board minutes. Hartman, Quandt and
<br />Stelk voted yes, Abernethy and Rosenkotter voted no, Landis and Leslie
<br />abstained.

<br />Deputy Attorney Jerry Janulewicz present for meeting.
<br />
<br />Chairman Abernethy stated she had received certified letter this morning from
<br />Dwyer, Pohren,Wood,Grimm IX Lazer Law Offices, Omaha, Nebraska, which she
<br />opened at this time and read to the Board Members. Letter was signed by
<br />Edward F. Pohren, of notice Hall County Public Defenders have retained their
<br />law firm to assist them with formation of a bargaining unit and to represent
<br />them in labor disputes with Hall County Board of Supervisors.
<br />Attorney Janulewicz explained to the Board his interpertation of forma-
<br />tion of bargaining unit but would not make a recommendation at this time. He
<br />requested more time to review letter before making recommendation.
<br />
<br />Attorney Janulewicz gave information on the State Board of Equalization
<br />meeting in Lincoln on August 11th. He will attend the hearing, Landis,
<br />Hartman and Quandt plan to attend the meeting also. Discussion followed.
<br />Landis asked if they have support of County Board members to appeal to the
<br />State Court of Appeal if that becomes necessary. Majority stated would be
<br />in sUPP9rt of an appeal if necessary.

<br />Dan Hostler, Public Works Director reported would not need the Resolution for
<br />condemnation of property for road right of way, which George Leiser refused
<br />to sell to County. Host~er explained to the Board Members his visit with
<br />State Officials in regard to right of way.
<br />Motion by Hartman, seconded by Landis to not condemn land and to build
<br />road on 33cl/2 foot of right of way. Abernethy, Hartman, Landis, Leslie,
<br />Quandt, and Rosenkotter voted yes, Stelk voted no. Motion carried.

<br />Neal Kelly, Representative of CWA spoke in regard to the bargaining with
<br />Public Works Department employees. Also present were Troy Hughes and Larry
<br />Braman, Co-Chairmen of the Public Works Department bargaining unit. Mr Kelly
<br />recapped the meetings with the bargaining committee and requested vote to
<br />accept the offer of 1% wage increase plus steps for 1995 and guarantee a
<br />3% increase plus step in 1996 for a two year contract. He stated steps are
<br />part of their agreement. He asked Board members to take comments of today
<br />under consideration and notify them of decision.
<br />
<br />Nelson Helm, Regional Planning Commission Director explained the Rathman
<br />Subdivision Final Plat which was presented for consideration. Rathman Sub-
<br />divison is located on west side of l30th Road, immediately north of old
<br />Potash Highway.
<br />Motion by Hartman, secpndedlty Landis to accept and authorize chairman
<br />to sign the Final Plat for :Rat~al!l Subdivision. Abernethy, Hartman, Landis,
<br />Leslie, Quandt, Rosenkotter and S~elk voted yes, none voted no. Motion
<br />carried.
