<br />95r - /3~ <br /> <br />:! <br /> <br />HALL COUNTY BOARD OF SUPERVISORS MEETING APRIL 25, 1995 <br /> <br />J <br /> <br />The Hall County Board of Supervisors met April 28, 1995 at 9:00 A.M. <br />from adjourned session and by published call with Irene Abernethy <br />presiding. <br /> <br />Present on roll call were Irene Abernethy, Richard Hartman, Margaret <br />Landis, Robert Leslie, Gary Quandt, Judy Rosenkotter and Tammie Stelk. <br /> <br />Invocation was given by James Kayser, Trinity United Methodist. <br /> <br />Minutes of the April 18 meeting were recieved and corrected. Quandt <br />made motion and Stelk seconded to accept minutes and place on file. <br />Abernethy, Hartman, Landis, Leslie, Quandt, Rosenkotter and Stelk <br />all voted yes and none voted no. <br /> <br />Jerry Piccolo. from the Public Defenders Office appeared to address <br />theilietters from Michael Morledge concerning the public defenders <br />office. The work that is done for the private practices is done <br />when county business is completed. Clients may be there during <br />office hours. Deputy public defenders are instructed that this <br />work is on their time and is their responsibility. All necessary <br />measurers are taken to insulate the county from any additional <br />liability. The state statutes allow deputy public defenders and <br />deputy county attorneys to have a private practice. This allows <br />quality legal talent to be hired for these offices. The status of <br />full ,and parttime was discussed. Deputy public defenders are listed <br />as professionals and are exempt from the 40 hour work week. The <br />use, of' county facilities for private endevor needs to be clarified. <br /> <br />I' , <br /> <br />; , <br /> <br />Michael Morledge, 105 North Wheeler, Grand Island, expressed his <br />concerns. He stated that he felt it was wrong for the deputy public <br />defenders to engage in a private practice and use county facilities <br />to do so.' Mr. Morledge questioned the full or parttime status of <br />the public defenders office.: Mr..M6rledge felt that the' questions <br />he asked were not answered. l' "i " " ,. <br /> <br />The state statutes allows deputies to have a private practice. <br />The,offic~ policy is very clear concerning private practice. It was <br />questioned if the Commission on Accountability and Dlsclosure should <br />be contacted. Quandt made motion and Landis seconded to draw up a <br />resolution to prohibit private practi~e in the public defenders <br />and the county attorneys office. ~~slie a~stainea, Ab~;n~th~, Ro~enkotter, <br />Stelk voted no and Hartman, Landis.and Quandt voted no. Mot10n d1d <br />not carry. <br />Quandt made amendment to motion to state out of the county offices, <br /> <br />I -"-'~--'-"-' ", --, <br />Deputy County Attorney Jerry Janulewicz to set up aLn~gQtiatmon-t, <br />team for the labor agreementwith the CWA. Jerry Janurewicz, Dan' <br />Hostler and Dick Hartman are to be on this committee. Janulewicz <br />reported on the progress on correcting the Clerk of the District <br />Court computer. The District Clerks office has started working <br />on the reconciliation of the checks on the computer system. <br />McDermott & Miller will then review the data. Janulew}cz_~resented <br />the contract for the replacement park land. The claim;__1 for the <br />$14,540.40 was presented and the chairman needs to sign the purchase <br />agreement. The board requested that Jerry send a letter to the <br />Nebraska Accountablity and Disclosure and the State Auditors office <br />concerning the discussion on the public defenders office. Hartman <br />made motion and Quandt seconded to have Jerry send the letter. <br />Abernethy, Hartman, Landis, Leslie, Quandt, Rosenkotter and Stelk <br />voted yes and none voted no. <br /> <br />PUBLIC PARTICIPATION <br /> <br />John Wagoner spoke on theLSuper Cell north of Grand Island. <br />He sent a letter to the StabeAuditor's'Office conerning this. <br />He also questioned the amount paid for the reappraisal and why <br />the protests have to be filed on the state provided forms. <br /> <br />Mike Nolan, 1450 South Gunbarrel Road spoke to the board on the <br />Paradise Estates Subdivisio~. He questioned why a subdivision <br />agreement was necessary and why it was taking so"long to get the <br />agreement drawn up. He requested a meeting with the Public Works <br />
