<br />91f 3()~ <br /> <br />Robert Boeka, general manager of Chief Industries, submitted <br />petition to have their property excluded from the industrial <br />tract The company is wanting to expand the busines~ and the city <br />utilities and storm sewer will be important to this expansion. <br /> <br />Jerry Niedfeldt, 1515 East Husker Highway, owns property in the <br />industrial tract and expressed concerns if the industrial tract <br />could be abandoned. Jerry Janulewicz stated under state statute <br />the property cannot be removed unless is requested by the <br />property owner. The industrial tracts were created in the 1950's <br />to provide a tax break to the business. The industrial tracts <br />will be reviewed in even number years but if the property owners <br />desire to remain in the industrial tract they may do so. <br /> <br />Dan Dunn, attorney for Chief Industries, said availability of city <br />utilities would allow for expansion of Chief Industries and the <br />possibility of applying for a block grant. Mr. Dunn requested <br />the board's favorable consideration on the petition. <br /> <br />Stelk made a motion and Lancaster seconded to close the public <br />hearing for the industrial tract. Abernethy, Hartman, Lancaster, <br />Landis, Long, Quandt and Stelk all voted yes and none voted no. <br />Motion carried. <br /> <br />APPROVE RESOLUTION TO EXCLUDE PROPERTY FROM INDUSTRIAL TRACT: Stelk <br />made a motion and Abernethy seconded to approve Resolution #97-0062 <br />to exclude property from an industrial tract. Abernethy, Hartman, <br />Lancaster, Landis, Long, Quandt and Stelk all voted yes and none <br />voted no. Motion carried. <br /> <br />RESOLUTION #97- () () tkq <br /> <br />A RESOLUTION CHANGING THE BOUNDARIES OF <br />A DESIGNATED COUNTY INDUSTRIAL AREA <br /> <br />~REAS, ChiefIndustries, Inc., hereinafter referred to as "Petitioner," is the owner of <br />the following described tract of real estate which is included within the boundaries of a designated <br />county industrial area, to wit: <br /> <br />Lot One (1) and Lot Two (2), ChiefFab Subdivision, Hall County, Nebraska; and <br /> <br />WHEREAS, On August 13, 1997, Petitioner filed with the Hall County Clerk its petition <br />for exclusion of the above-referenced tract from the designated county industrial area within <br />which said tract is located; and <br /> <br />WHEREAS, On September 16, 1997, upon notice as required by Neb. Rev. Stat. sec. 13- <br />1113 and 13-1119, the Hall County Board of Supervisors held a public hearing upon said petition. <br /> <br />NOW BE IT RESOLVED, The Hall County Board of Supervisors hereby finds that the <br />best interests of the community and the industrial area will be served by the exclusion of the <br />above-described tract from the designated county industrial area. It is therefore Ordered that said <br />tract is hereby excluded from the designated county industrial area and the boundaries thereof are <br />hereby changed according to this order. When a certified copy of this order is filed with the Hall <br />County Register of Deeds and with the Hall County Assessor, such tract shall no longer be <br />included within the industrial area. <br /> <br />PASSED AND ADOPTED ON SEPTEMBER 16,1997. <br /> <br />HALL COUNTY BOARD OF SUPERVISORS <br />,/7 <br />.
