<br />q1~- /~J1 <br /> <br />6 <br /> <br />004 10D Bya duly authorized representative of the persons described in <br />paragraphs 004 lOA to 004 OIC of this Chapter if such representative is <br />responsible for the overall operation of the activity, the authorization is made in <br />writing by the person designated in paragraphs 004 0 I A to 00 0 I C of this <br />Chapter, and the written authorization is submitted to the Director. <br /> <br />004 02 Any change in an authorization meeting the requirements of paragraph 004 0 I D <br />of this Chapter shall be submitted to the Department in writing prior to or together with <br />any application or report to be signed by an authorized representative. <br /> <br />QUi Application; Additional Information Requests. <br /> <br />The thirty (30) days filing requirement for permits shall commence after all the necessary <br />information has been received by the Department. No permit application submitted to the <br />Department shall be considered for processing until all information necessary to complete the <br />application or additional information as required by the Department has been received. <br /> <br />QQ6. Permit Conditions; General. <br /> <br />The following general conditions shall apply to all permits: <br /> <br />006 0 I Duration, see paragraph QQ1 of this Chapter; <br /> <br />006 02 Retention by permittee of any records required by this Chapter for a minimum of <br />three (3) years; and <br /> <br />006.03 Responsibility of permittee to comply with all other applicable local, state, and <br />federal requirements. <br /> <br />QQ1 Duration. <br /> <br />Each issued permit shall have a fixed term not to exceed twelve months from the date of issuance. <br /> <br />008. Transferability of Permits. <br /> <br />008 01 A permit may not be transferred. <br /> <br />Q.Q2. Modifying, Suspending, or Revoking Permits. <br /> <br />009.01 Any permit issued may be modified, suspended, or revoked in whole or in part <br />during its term for cause, including, but not limited to: <br /> <br />009 0 I A A violation of any terms or conditions of the permit. <br /> <br />009 0 I B Obtaining a permit by misrepresentation of any relevant facts or failure <br />to disclose fully all relevant facts; <br /> <br />009 01 C Information indicating that the permitted activity or operation poses a <br />threat to human health or the environment; <br /> <br />009 0 I D A change in the ownership or control of an activity or operation which <br />has a permit; <br /> <br />009 OlE Upon request by the permittee, provided such request does not create a <br />violation of any existing applicable requirements, standards, laws, or rules and <br />regulations. <br /> <br />009 02 A permit may be suspended immediately by written order of the Director for a <br />material violation of the standards set forth in Chapter 3 of these regulations. In the event <br />of a suspension, written notice of the order and the reason for the suspension shall be <br />served upon the permittee, who may request a hearing before the Director on said <br />suspension by filing a written request for a due process hearing within ten (10) days of its <br />receipt. Said due process hearing shall be held and a decision rendered within 10 days of <br />the Director's receipt of the request wtless such time period is waived by the parties. A <br />permit may not be revoked or modified by the Director until reasonable notice and right <br />to a hearing thereon has been afforded to persons having a legal interest in the proceeding. <br />Any final order suspending, revoking, or modifying a permit may be appealed to the Hall <br />County Board of Supervisors by filing a written appeal with the Director within 10 days <br />of the date of the order. <br />
