Non-resident employees shall only be permitted on a conditional use permit approval <br />basis. <br /> <br />f The home occupation activity shall not involve dangerous, toxic or hazardous <br />chemicals or products on-site, which require specialized handling, licensing and/or <br />disposal in accordance with State or Federal regulations. <br /> <br />g. Total floor area utilized for actual automotive engine or small engine repairs shall not <br />exceed 300 sq. ft. <br /> <br />h. Auto body repair/paint shops, animal kennels, boiler and tank work, welding and <br />metal fabrication, ;mimal slaughter and any other permitted or conditional uses mrique to <br />the GI-General Industrial Zone shall be prohibited as a home occupation use; <br /> <br />and <br /> <br /> <br />WHEREAS, on February 13, 1997, the Hall COlDlty Board of Supervisors held a public <br />hearing on said proposed amendment to the Hall COlDlty Zoning Resolution, said public hearing <br />held upon due and proper public notice thereon; and <br /> <br />WHEREAS, following said public hearing the Hall Cmmty Board of Supervisors <br />considered the recommendations of the Regional Planning Commission and the comments <br />received at said public hearing. <br /> <br />NOW BE IT RESOLVED that that SECTION 4. DEFINITIONS, Home OccupatiQ!!, be <br />amended by repealing the original definition in its entirety and inserting the following: <br /> <br />Home Occupation Use: A business, occupation or profession, including room and board <br />(maximum of two persons) and child care, carried on within a residential dwelling and/or <br />the associated accessory buildings thereof, wherein the use of the residential dwelling <br />unit and/or the accessory buildings for the home occupation use shall be clearly <br />incidental and subordinate to its use for residential pwposes by the occupants. The <br />following operation characteristics and requirements must also be satisfied in <br />order'to qualify as a home occupation use: <br /> <br />a. There shall be no change to the external appearance and residential character of the <br />land or buildings involved (all aspect of the use, including storage, must be confined <br />within the principal residence or accessory buildings); <br /> <br />b. No equipment or processing shall be allowed that creates visual or audible <br />interference in any radio or television receivers off the premises (including line voltage <br />fluctuations); or, creates obtrusive noise, vibration, heat, glare, fumes, dust, odors, <br />emissions or electrical interference detectable to the normal senses off the premises; <br /> <br />c. Does not involve more than 35% of the total floor area of the residence and 50% of <br />the combined floor area of any attached or detached accessory buildings; <br /> <br />d Does not require an identification sign other than one non-illuminated, flat momt or <br />freestanding sign, not exceeding thirty-two (32) square feet in area. <br /> <br />e. Non-resident employees shall only be permitted on a conditional use permit approval <br />basis. <br /> <br />f The home occupation activity shall not involve dangerous, toxic or hazardous <br />chemicals or products on-site, which require specialized handling, licensing and/or <br />disposal in accordance with State or Federal regulations. <br /> <br />BE IT FURTIIER RESOLVED that SECTION 5, subsections l.(c), 2.(c), 3.(c), 4.(c), <br />5.(c), and 6.(c) be amended by adding "Home occupation [non-resident employees]" as a <br />permitted conditional use within the respective zoning districts. <br /> <br />As amended by this resolution, the Hall Cmmty Zoning Resolution shall remain if full <br />force and effect. <br /> <br />Passed and adopted this ~day of March, 1997. <br /> <br />~ <br /> <br />
