<br /><1 6>Fb~tC4 <br /> <br />ATTACHMENT "A" <br /> <br />Proposed Amendments to Hall County Zoning Resolution to Address Control of Intensive Hog <br />Confinement Facilities: <br /> <br />Amend Section 4. Definitions to add the following definition of "farming operation" <br /> <br />farming operation - The planting, cultivating, harvesting and storage of grains, cereal crops, <br />forage crops, hay or other plant materials. <br /> <br />Amend Section 4. Definitions to replace the existing definition of "feed lot" with the following: <br /> <br />feedlot - The confined feeding of animals or commercial feeding of livestock in buildings, lots or <br />pens which are not used for the raising of crops or the grazing of animals. Except for temporary <br />confinement, such as during seasonal adverse conditions, the term -reedlot" shall include the <br />confined feeding of: (1) Uvestock when not in conjunction with a farming operation; or, (2) Over <br />150 feeder or fat cattle; over 100 beef cows or dairy cows; over SOO swine including farrowing of <br />pigs; over 2,000 sheep; over 3, 000 turkeys; or, over 10,000 chickens, ducks or geese. <br /> <br />Amend Section 5.1(a) AG-1 Agricultural- Permitted Principal Uses to make the following permitted uses <br />subject to Section 5.1 (f) Miscellaneous Provisions: <br /> <br />Ranch and farm dwellings <br />Recreational camps, parks, playgrounds, golf courses, country clubs, tennis courts, riding <br />academies and other similar recreational uses. <br />A dwelling, single-family <br /> <br />Amend Section 5.1(a) AG-1 Agricultural- Permitted Principal Uses to make the following change: <br /> <br />Agricultural uses including feedlots and the commercial feeding of livestock (excepting any feedlot <br />or commercial feeding involving more than 3,000 swine and/or more than 600 sows). <br /> <br />Amend Section 5.1(c) AG-1 Agricultural- Permitted Conditional Uses. to add the following: <br /> <br />Feedlots and the commercial feeding of livestock involving more than 3,000 swine andlor more <br />than 600 sows. <br /> <br />Amend Section 5.1 (f) AG-1 Agricultural - Miscellaneous Provisions to add the following: <br /> <br />No dwelling (other than that of the feedlot owner/operator), church, school, recreational camps, <br />parks, playgrounds, golf courses, country clubs, tennis courts, riding academies and other similar <br />recreational uses shall be permitted in this zoning district, within 5,280 feet of a hog confinement <br />facility subject of a conditional use permit approval. <br /> <br />Any conditional use permit application for a hog confinement facility must satisfy the following <br />requirements: <br /> <br />1. The applicant must verify that the proposed confinement facility or feedlot meets <br />the license requirements and waste disposal requirements of the State of Nebraska; <br /> <br />2. A hog confinement facility (including earthen ponds. lagoons and the livestock confinement <br />area) shall be set back a minimum distance of 5,280 feet from an existing dwelling (other than <br />those of the feedlot owner/operator), a church, a school, recreational camps, parks, <br />playgrounds, golf courses, country clubs, tennis courts, riding academies and other similar <br /> <br />Page 1 <br />
