<br />Cj:s-?' rt!J ~g <br /> <br />RESOLUTION #98-.fJ2.3 3 <br /> <br />A RESOLUTION DESIGNATING THE CITY OF GRAND ISLAND AS TRANSFEREE <br />OF PROPERTY LOCATED AT THE CORNHUSKER ARMY AMMUNITION PLAN <br /> <br />WHEREAS, Public Law 103-337, sec. 2836 authorizes the Secretary of the Army to <br />convey to the Hall CountY.,Nebraska"Board of Supervisors or its designee all right, title and interest <br />of the United States in and to the real property that is the site of the Cornhusker Army Ammunition <br />Plant, hereinafter referred to as "CAAP," for fair market value, said property to be used in a <br />manner consistent with the CAAP Reuse Committee's Comprehensive Reuse Plan, hereinafter <br />referred to as the "Reuse Plan"; and <br /> <br />WHEREAS, the City of Grand Island has proposed a plan to utilize the real estate <br />described herein for development, construction, and operation of a public firearm sports facility <br />and for other recreational uses appurtenant thereto; and <br /> <br />WHEREAS, the use of said property for public recreational purposes is consistent with the <br />CAAP Reuse Committee's Comprehensive Reuse Plan. <br /> <br />BE IT RESOLVED, the Hall County Board of Supervisors hereby designates the City of <br />Grand Island, hereinafter referred to as the "City," as the transferee of the following lands located <br />at the Comhusker Army Ammunition Plant, to wit: <br /> <br />all lands located in Section 29 , Township II North, Range I 0 West of the 6th P.M., in <br />Hall County, Nebraska, which lies north of Husker Highway extending to 4th Street and <br />between the existing railroad tracks (3 rd Avenue) and 5th Avenue, consisting of 410.15 <br />acres more or less, <br /> <br />including all buildings and improvements thereon except the following residences and garages to <br />wit: ER-2, ER-5, ER-6, ER-8, ER-9, ER-10, ER-13, RG-2, and RG-6. Said lands shall be used <br />for public recreational purposes. <br /> <br />BE IT FURTHER RESOLVED, the above described transfers shall be subject to the <br />following conditions, restrictions, and limitations: <br /> <br />1. Survev And Changes In Descriptions And Parcels. The above descriptions ofIand is <br />approximate and intended ooIy to describe"'tHe general area to be conveyed to the City. <br />The City shall furnish a perimeter survey ~f said parcel to the Hall County Board of <br />Supervisors. The Hall County Board of Supervisors and the CAAP Reuse Committee <br />may require changes to any parcel description, boundary, or dimensions or require <br />designations of easements as necessary to accommodate the needs of the County of Hall <br />or the CAAP Reuse Committee. <br /> <br />2. Abandonment Of Designation. The County of Hall may rescind and cancel this <br />designation in whole or in part if the designation is abandoned by the City or is not <br />concluded within 24 months following a determination by the Department of the Army <br />that said property is eligible and available for transfer or sale. <br /> <br />c} <br />
