<br />~I- t:J/c?~ <br /> <br />WHEREAS, the comprehensive reuse plan adopted by the CAAP Reuse <br />Committee and approved by the Hall County Board of Supervisors designates for the <br />Husker Harvest Days site a tract of land containing approximately 939 acres and located <br />in the southwest comer of the CAAP. <br /> <br />BE IT RESOLVED, the Hall County Board of Supervisors hereby designates the <br />Farm Progress Co., Inc., hereinafter referred to as the "Farm Progress," as the transferee <br />of the following lands located at the Comhusker Army Ammunition Plant, to wit: <br /> <br />United States land within the boundaries of the Comhusker Army <br />Ammunition Plant, Nebraska, designated as Tract 53 and Tract 54, lying <br />within that portion of the West One-half (W V2) of Section 25, and all of <br />Section 26, Township Eleven (11) North, Range Eleven (11) West of the <br />6th Principal Meridian, Hall County, Nebraska, <br /> <br />subject to public road right-of-ways of record. <br /> <br />BE IT FURTHER RESOLVED, the above designation shall be subject to the <br />following conditions, restrictions, and limitations: <br /> <br />1. Survey And Changes In Descriptions And Parcels. The above description of <br />lands is approximate and intended only to describe the general area to be <br />conveyed to Farm Progress. Farm Progress shall furnish a perimeter survey of <br />said parcel to the Hall County Board of Supervisors. The Hall County Board of <br />Supervisors and the CAAP Reuse Committee may require changes to any parcel <br />description, boundary, or dimensions as necessary to accommodate the needs of <br />the County of Hall or the CAAP Reuse' Committee. <br /> <br />2. Abandonment of Designation. The County of Hall may rescind and cancel this <br />designation in whole or in part if the designation is abandoned by Farm <br />Progress or is not concluded within 24 months following a determination by the <br />Department of the Army that said property is eligible and available for transfer <br />or sale. <br /> <br />3. Transfer And Assignments. This designation of Farm Progress as transferee <br />shall not be assigned or transferred by Farm Progress except with written prior <br />consent of the Hall County Board of Supervisors. <br /> <br />4. Obligations to Inform County. Farm Progress shall inform the Hall County <br />Board each quarter of activities between Farm Progress and the Department of <br />the Army relative to the conveyance of the above properties. <br /> <br />5. Amendments. The terms of this resolution may be modified or amended upon <br />written agreement of the Board and Farm Progress. <br /> <br />PASSED AND ADOPTED THIS4fh DAY OF JUNE, 1998. <br /> <br />7 <br />
